As Mr Hutton has admitted this breach we find the charge proved.

Penalty:

Accordingly we suspend Mr Hutton's license to ride in races from the completion of racing on 21 January until the completion of racing on 26 January 2015, 4 days.

Facts:

Following the running of Race 1, the DALTONS 2000, an Information was lodged by Mr Williamson alleging that Apprentice Rider B Hutton allowed his mount to shift inwards, taking OPULENT inwards which had to steady causing a check to THE LION QUEEN (Mr V Colgan) which was checked near the 1500 metres, and lost ground.

Mr A Scott was at the hearing to assist Mr Hutton who acknowledged that he admitted the breach and that he understood the Rule.

Rule 638(1)(d) states' A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless''

Stipendiary Steward Mr N McIntyre demonstrated the incident on the available films. He pointed out that shortly after the horses passed the winning post the first time Mr Hutton's mount RUSSIAN MAGIC was racing in a 3 wide position outside OPULENT (Mr M Cameron) with THE LION QUEEN (Mr V Colgan) inside that horse.

Mr McIntyre pointed out that Mr Hutton had then directed his horse inwards in an attempt to obtain a better position, however in doing so he had applied pressure to OPULENT. Mr Hutton had taken corrective measures for approximately 20-30 metres, however had then again let RUSSIAN MAGIC shift in towards OPULENT. As a result Mr Cameron had to take evasive action which caused a sharp check to THE LION QUEEN on his inside. As a result that horse blundered and Mr Colgan was placed in a difficult position, losing some lengths as a result.

Mr Hutton, for his part, stated that THE LION QUEEN had 'fumbled' when it went over the track crossing. He admitted that he had applied pressure onto OPULENT however.

Mr Scott submitted that THE LION QUEEN had been over-racing at the time of the incident and had contributed towards the check itself. He added that in his opinion the incident had been at the low end of carelessness.

Submissions for Penalty:

Mr Williamson produced Mr Hutton's riding record which showed one previous breach of this Rule within the past 12 months when he was suspended for 4 days.

Mr Willamson submitted that THE LION QUEEN had received a reasonable amount of interference as a result of Mr Hutton's actions as he was a bare 3/4 length clear of OPULENT when making an inwards movement. He added that there was not a great inwards shift by Mr Hutton and that the breach was in the low to mid range. He added that THE LION QUEEN had been placed in a restricted position and had reacted poorly when placed under pressure from OPULENT on its outside. Mr Williamson submitted that a suspension of between 4-5 days would be the Stewards' position when considering an appropriate penalty. He added that the Stewards considered Mr Hutton to be a North Island rider.

Mr Hutton stated that there had been a couple of surrounding factors in his defence. He believed that THE LION QUEEN had been over-racing,  and that his inwards shift onto OPULENT had not been severe.

Reasons for Penalty:

The Committee took into consideration the submissions and evidence presented. To Mr Hutton's favour is that he had admitted the breach, and that he has a good record in respect of this Rule being breached. We accept that there was a bare 3/4 length between Mr Hutton's mount and OPULENT at the time this incident took place.

We adopted a 5 day suspension as a starting point when considering an appropriate penalty. While there was resulting consequences for 2 runners inside him, we believed Mr Hutton's actions fell into the low to mid range on the level of carelessness.

Taking all of the above into account the Committee believed that an appropriate penalty was a suspension of 4 riding days.
