Facts:
Following the running of Race 2 the “Matt Blair Motors Trot” an Information was filed by Stipendiary Steward Mr S Wallis alleging a breach of Rule 869 (2) (a) by Open Horsewoman Ms M Perriton. The Information stated that Ms Perriton used her whip in contravention of the use of whip guidelines.
Ms Perriton signed the information stating she admitted the breach and that she did not wish to be present at the hearing of the information.
Rule 869(2) provides 'No horseman shall during any race use his whip in an unnecessary, excessive, or improper manner'.
The Use of Whip Guidelines (effective 1 November 2017) provides (b) No horseman is permitted to use their whip in a striking motion on more than ten occasions inside the final 400 metres. This is inclusive of “backhanders” and the use applies to the horse, harness and/or sulky.
Mr Wallis used the race video to identify Ms Perriton driving (7) NOBLE MISTRESS approaching the home straight. He pointed to Ms Perriton using her whip 13 times within the final 400 metres.
Mr Wallis stated that Ms Perriton disagreed with the alleged number of strikes. He submitted that she thought it was 11 strikes.
The Committee viewed the films carefully and counted 13 strikes.
Submissions for Penalty:
Mr Wallis said this was a clear breach of the whip rule and using the sliding scale Penalty Guide for this number of strikes which is $200, the Stewards saw this as an appropriate penalty.
Reasons for Penalty:
The Committee, in determining penalty, found that there were no exceptional aggravating or mitigating factors to deviate from the JCA Penalty Guide.
