Facts:

Following the running of Race 3, Mr Pitman, the Trainer of the second placed horse WATCHMAKER protested against the first placed horse TRADITION alleging interference in final 100 metres.

The Judge’s placings were:
1st - 4 TRADITION
2nd - 3 WATCHMAKER
3rd - 12 VIVA LA BLUES
4th - 6 SHOCK PROSPECT

The winning margin was a ï»¿½ ï»¿head.

Submissions for Decision:

Mr Pitman with reference to the videos said that WATCHMAKER was full of running and was looking like going past TRADITION when TRADITION rolled out and took WATCHMAKER’s line. He said Mr Cuneen had never stopped urging and had not straightened his horse as he was obliged to do under the Rules. He demonstrated on the videos his belief that WATCHMAKER had lost momentum on two occasions when TRADITION rolled out. He estimated it had cost WATCHMAKER half a length, if not more.

Mr Chowdhoory said he agreed with what Mr Pitman said. He had been hindered by TRADITION in the last 100 metres.

Mr Tapper said WATCHMAKER had been veering to the outside before the incident. He believed WATCHMAKER had simply kept shifting out. He believed Mr Chowdhoory had never stopped riding and he emphasised that the horses had never touched. He said his horse had definitely moved, but he did not agree that this had hindered the chances of Mr Chowdhoory.

Mr Cuneen said TRADITION had found the line well. The horse had wanted to lay out slightly but there was no contact. He believed TRADITION had won convincingly.

Mr Pitman responded by emphasising three things: Mr Cuneen had not tried to straighten TRADITION; WATCHMAKER had lost momentum as a result of the shift; and WATCHMAKER was making up ground on TRADITION on the line.

Mr Davidson in his capacity as Stipendiary Steward commented on the video and the oral evidence. He said there was clearly a significant shift by TRADITION. The obligation on Mr Cuneen was to straighten his mount. He had not done this. There was no contact, but WATCHMAKER was clearly shifting away from the movement by TRADITION. He said there was loss of momentum, the margin was only a ½ head and it appeared WATCHMAKER was closing on the winning post.

Reasons for Decision:

TRADITION has clearly shifted wider on the track over the final 100 metres. Mr Tapper is correct when he says WATCHMAKER had shifted wider earlier in the straight. This is prior to the shift by TRADITION. This shift by TRADITION is quite marked and is approximately four to five horse widths over a distance of approximately 100 metres. Mr Cuneen has made no attempt to straighten TRADITION and, in so shifting, he has dictated the running line of WATCHMAKER. Despite there being no contact, WATCHMAKER loses momentum as a result of TRADITION shifting it wider on the track. Whether it is the ½ length that Mr Pitman has alleged does not need to be determined, but it is at least the ½ head margin between first and second at the end of the race. Significantly, WATCHMAKER has finished off the race strongly and was making up ground on TRADITION at the winning post.

The Committee is satisfied there was interference by TRADITION to WATCHMAKER and that had this not occurred it is of the opinion that WATCHMAKER would have finished ahead of TRADITION
