As Mr Kamaruddin admitted the breach the Committee found the charge proved.

Penalty:

The Committee granted a deferment to Mr Kamaruddin’s suspension pursuant to Rule 1106(2).

Accordingly, Mr Kamaruddin had his license to ride in races suspended for a period to commence after racing on 23 June and conclude after racing on 6 July 2019.

Facts:

Following the running of race 9, Haunui Farm 1600, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Williamson, alleged that Mr Kamaruddin allowed his mount KINGS SECRET to shift in when not sufficiently clear of ROBUSTO, RED BEACH and DEEJAY MAC which were all crowded and hampered near the 1350 metres.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Kamaruddin said that he understood the Rule and confirmed he admitted the breach.

Mr Harris and Mr Richards assisted Mr Kamaruddin at the hearing.

Mr Jones demonstrated the incident using the available video footage. He identified that Mr Kamaruddin shifted inwards on a sharp angle from an 8 wide position to a 1 off position near the 1350 metres. He said KINGS SECRET (Mr Kamaruddin) was a bare length clear of ROBUSTO which was crowded and hampered along with RED BEACH and DEEJAY MAC which lost ground.

In addition Mr Jones pointed out that Ms Spratt, the rider of RED DAKOTA, took a hold of her mount after anticipating the interference that occurred in front of her.

Mr Richards said that Mr Kamaruddin misjudged the margin he was clear of runners to his inside. He accepted that Mr Kamaruddin shifted inwards on a sharp angle and he would learn from today’s experience.

Mr Harris said that Mr Goindasamy, the rider of ROBUSTO, had called out to Mr Kamaruddin to “go” but he meant go forward and not to go across towards the rail.

Submissions for Penalty:

Mr Williamson said that Mr Kamaruddin was having his 14th race day ride and his record was clear. He said that Mr Kamaruddin shifted inwards on an abrupt angle and the interference was not too bad. However, he stated the angle in which Mr Kamaruddin shifted inwards caused other riders to anticipate a worse outcome. He submitted under the circumstances a low penalty would be fitting.

Mr Richards advised the Committee that Mr Kamaruddin had engagements at Te Aroha on 23 June and any proposed suspension could start after that date.

Mr Harris reiterated that Mr Kamaruddin was still learning his trade.

Reasons for Penalty:

The Committee considered all the evidence and submissions presented.

When reviewing the video footage the Committee found that Mr Kamaruddin allowed his mount to shift inwards in an abrupt manner when not his own length and one other clear length in front of other horses. It was evident that Mr Kamaruddin shifted in from an 8 wide position to a 1 off position when crossing the face of the field passing the 1350 metres. The head on film was compelling, it showed that Mr Kamaruddin looked to his inside on 4 occasions yet he continued to shift inwards when insufficiently clear to do so. The angle in which Mr Kamaruddin shifted was too sharp and resulted in ROBUSTO, RED BEACH and DEEJAY MAC all being crowded and their progress was impeded to various degrees. The Committee deemed the level of carelessness displayed by Mr Kamaruddin was in the midrange.

The JCA Penalty Guide starting point for midrange carelessness is 8 national riding days which we adopted.

The mitigating factors were Mr Kamaruddin’s admission of the breach and his inexperience as an apprentice rider. For these collective factors he was afforded a 1 day reduction in penalty.

After taking into account all the above factors the Committee considered that an appropriate suspension was 7 national riding days.
