After viewing the videos and hearing the relevant evidence the charge was found proved.
Penalty:
Mr Wahab is suspended for two days from the completion of racing on January 1st 2017 up to and including the 5th January 2017. This is two South Island days (Central Otago 2nd and Reefton 5th).
Facts:
Following the running of Race 1 the McCRAW FARRIER RATING 65 1600, Stewards lodged an Information alleging “S Wahab (River Raider) shifted inwards about the 700m when not clear of Flying Sardine (K Kalychurun) and as a result Flying Sardine was checked and lost momentum".
Rule 638 (1) (d) reads:
A rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless.
Mr Wahab attended the hearing and was assisted by Mr Harnett. As this is the first time Mr Wahab had appeared before a Judicial Committee, on any charge, prior to the commencement of the hearing the process was explained to him. Following the reading of the Rule Mr Wahab indicated he understood the nature of the charge and confirmed he admitted the breach of the Rule.
Mr McLaughlin, with the assistance of the video replays showed the relevant positions of RIVER RAIDER and FLYING SARDINE as they approached the 700m mark. Both horses were racing near the rear of the field with FLYING SARDINE on the rail and RIVER RAIDER on its outer. As they moved into the bend RIVER RAIDER was ahead of FLYING SARDINE and shifted inwards causing a check to FLYING SARDINE.
Mr Davidson stated Mr Wahab allowed his mount to lay in on the bend. Mr Kalychurun had his horses head turned inwards to try and keep clear and eventually had to check his mount, losing ground and momentum.
Mr Harnett said Mr Wahab had made an error in allowing his mount to lay in on the bend.
Submissions for Penalty:
Mr Davidson submitted that Mr Wahab had no breaches of any Rule. He had been riding in the South Island for several months after being previously based in the North Island. He viewed the breach as at the low end of the scale and sought a suspension of two days.
Mr Harnett submitted that Mr Wahab was an apprentice jockey with an excellent record. He had admitted the breach at the first opportunity and that the breach was at the low end of the scale. Mr Wahab was also seeking a deferment of any suspension as he had confirmed rides at upcoming meetings.
Reasons for Penalty:
After hearing penalty submissions from both parties we adopt a South Island starting point of three days suspension. There are no aggravating features and therefore no uplift. Credit is given for Mr Wahab’s guilty plea and his excellent record. Any suspension would also be deferred for seven days.
