Facts:
After the running of race 5 the siren sounded indicating a protest brought under rule 869. Alleging that horse 10 ‘Gwynfromeartoear’ provisionally placed 4th by the judge interfered with Supreme Christian driven by J. Abernethy, with approximately 450 metres to run. The provisional placings as called by the judge were 3-2-1-10-8.Mr. Taumanu showing the available films pointed out the incident when on the point of the bend after pulling the ear plugs, Mr. Gillies horse moved sharply inwards causing Mr. Abernethy’s drive to break.
Submissions for Decision:
Mr. Gillies, the driver of Gwynfromeartoear representing trainer Mr. Berger agreed he did pull the plugs on the point of the bend and did move inwards. He felt he didn’t tighten Mr. Abernethy and didn’t squeeze him up.
Mr. Taumanu submitted the films clearly showed the inward movement causing the tightening and subsequent breaking.
Reasons for Decision:
The committee, after revisiting the films on a number of occasions, firmly believe that the movement inwards by Mr. Gillies was the sole cause of Mr. Abernethy’s drive breaking and going back onto two other horses travelling behind.
