Accordingly, the net result of our deliberations was that Mr Coleman’s license to ride in races is suspended for a period commencing after racing on 22 August 2018 and concluding after racing on 6 September 2018 (9 national days).
Facts:
This charge arises from running of race 6, the Group 2 Lisa Chittick Foxbridge Plate. Chief Stipendiary Steward, Mr J Oatham filed an Information pursuant to Rule 638(1)(d) alleging that Mr Coleman (FRANCALETTA) "permitted his mount to shift in near the 950 metres when insufficiently clear of CONTESSA VANESSA which clipped heels and blundered".
Mr Coleman acknowledged that he understood the Rule and confirmed his admission of the breach.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Using available video footage Stipendiary Steward, Mr B Jones identified the horses involved in the incident, namely FRANCALETTA (M Coleman), CONTESSA VANESSA (R Elliot) and WAR AFFAIR (D Johnson). He said FRANCALETTA drew an outside barrier and approaching the 950 metre mark Mr Coleman allowed his mount to shift inward taking the running line of CONTESSA VANESSA. As a result CONTESSA VANESSA clipped heels and blundered and drifted back onto WAR AFFAIR which was subsequently hampered. Mr Jones pointed out that Mr Coleman turned FRANCALETTA’S head outwards in an effort to avoid the impact of the inward shift, but it was too late. He added that at the point of the interference Mr Coleman’s mount was no more than a length clear of CONTESSA VANESSA.
In response Mr Coleman readily conceded that he did not correctly judge the margin of his inward shift. He said he deeply regretted causing interference of this nature in a ‘black type’ race and he didn’t realise he caused the interference until after the race when he was shown the race footage.
Submissions for Penalty:
Mr Oatham produced Mr Coleman’s record which showed 2 previous breaches of the careless riding rule in the past 12 months, the most recent being on the 3rd of March 2018. He said that Mr Coleman’s overall record is relatively good and he simply misjudged the inward shift when going forward. He said the level of carelessness was in the mid-range and the aggravating factor is that the interference occurred in a Group 2 race carrying a stake of $100,000.
In reply Mr Coleman advised the Committee he had riding engagements up to and including 22 August 2018 at the forthcoming Taupo meeting and asked the Committee to consider a deferment when determining dates for any proposed suspension. Mr Coleman agreed with the Stewards' submission that his level of carelessness was in the mid-range and he asked the Committee to note that his proposed penalty is likely to include a suspension which will encompass the Group 1 race at the Premier Hastings meeting on 1 September 2018.
Reasons for Penalty:
In determining an appropriate penalty the Committee carefully considered all the evidence and submissions presented.
Our interpretation of the incident was that Mr Coleman was caught in a 7-wide position at the 1000 metre mark. He then looked in prior to permitting his mount to shift in 1 horse width when barely one length clear of CONTESSA VANESSA. The Committee noted that Mr Coleman did turn his mount's head out after the shift in, but at that stage the interference had already occurred. Although the level of carelessness in executing the inward manoeuvre was low, the consequences to CONTESSA VANESSA, in the view of the Committee, place Mr Coleman’s culpability in the mid-range. CONTESSA VANESSA clipped heels blundered significantly and eased back on to WAR AFFAIR.
The Penalty Guide for Judicial Committees recommends that the starting point for mid-range carelessness is 8 national riding days. The Committee adopted this as the starting point.
The mitigating factors that we took into account included Mr Coleman’s admission of the breach and his good riding record under this rule. The combined effect resulted in a 1 day reduction from the 8 day starting point.
Pursuant to Rule 920 (2) the Committee added 2 additional days in recognition of the status of the race and stake payable.
