Facts:
Following the running of Race 7 (AME Electrical 2040), Information A2730 alleging a breach of Rule 638(3)(b) was filed with the judicial committee. It alleged that "Rider J Parkes (FRENCH PERFUME) used his whip excessively prior to the 200 metres".
The rule was read and Mr Parkes confirmed he understood the rule and that he admitted the breach.
Using the head-on and side-on films, Mr Goodwin identified that as FRENCH PERFUME turned for home, apart from a brief respite, Mr Parkes had used his whip on the horse 10 times in quick succession. He submitted that although Mr Parkes has given a brief respite for two to three strides, it was not a sufficient reprieve for the required six strides.
Mr Parkes submitted that his horse was lugging in quite badly as he turned for home, and he was also trying to adapt to riding with his whip in his left hand on this occasion. He had simply not thought of his actions and believed it to be an honest mistake.
Submissions for Penalty:
Mr Goodwin submitted a previous breach of this rule on 29 November 2014, for which he was fined $500. Mr Goodwin described his record as not good, although he believed the degree of the current breach could be defined as "not too excessive". In light of the JCA Penalty Guidelines, he submitted a fine was appropriate.
Mr Parkes submitted that he was aware that there had been an uplift in JCA Penalty Guideline Starting Points for whip charges. He stated he was a busy rider and submitted a $500 fine rather than a period of suspension was appropriate.

The JCA Penalty Guide suggested a starting point of a $500 fine. Mr Parkes is a busy rider who is very familiar with the whip guidelines. While he provided a brief reprieve of around 3 strides, this is well short of the 6 strides required under the guidelines.
