Rule 534 (2) (b) provides: If the Stipendiary Steward is not so satisfied, he shall complete an information and file it with the registrar for the Judicial Committee and the Judicial Committee shall then determine whether there are such circumstances and whether the owner or lessee (as the case may be) or his agent or its racing manager is authorised to scratch the horse after that time.
Prior to race 7, The Goodwin Property Management 1200, a request for a ruling was filed as to whether there are circumstances which warrant NINE PIN being scratched.
Submissions for Decision:
Mr Williamson submitted that the stewards were satisfied that there were no circumstances warranting NINE PIN to be scratched. Mr Molloy's request came after the scratching deadline and there had been no subsequent downgrading of the track.
Mr Molloy submitted his request to scratch NINE PIN was in the interests of the horse and the betting public as he was aware NINE PIN would have started as hot favourite. He conceded that he was in breach of the rule and would have to accept the penalty imposed.
Reasons for Decision:
The committee considered the facts surrounding the request to scratch NINE PIN. As there had been no downgrade in track conditions prior to this request for a ruling which was outside the scratching deadline the committee is satisfied there are no circumstances which justify NINE PIN being scratched.
