As Ms Spratt admitted the breach we find the charge proved.
Penalty:
Accordingly, we impose a suspension on Ms Spratt which will commence after racing on 3rd June and conclude after racing on 10th June 2013 (4 days).
The penalty did not include any South Island meetings as Ms Spratt confirmed that she did not intend riding at any upcoming South Island meetings.
Ms Spratt had no commitments at Ellerslie on June 3 and as declarations for riders had closed we did not include this day in her penalty.
Charge:
Following race 4, Swiss Deli Cornwall Handicap, an information was filed pursuant to Rule 638(1)(d). The Informant, Mr Oatham, alleged that Ms Spratt permitted her mount MONTETRA to shift outwards under hard riding over the final 100 metres forcing MASTER MICHAEL and DARK BISHOP off their rightful lines of running.
Ms Spratt acknowledged that she understood the nature of the charge and the Rule.
Rule 638(1)(d) states : A rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Facts:
Mr Robinson demonstrated the incident on films available which showed Montetra starting to move ground outwards approaching the 100 metres. He said Ms Spratt continued hitting her mount 12 times when it was moving out 3 to 4 horse widths. Mr Robinson submitted this outward movement shifted the 2 horses on her outside of their rightful line of running.
Ms Spratt admitted she did shift out over the final 100 metres and should have straightened her mount up but noted it had been hanging during the running.
Submissions for Penalty:
Mr Oatham produced Ms Spratt's record which showed 3 previous breaches under this rule in the last 12 months which he believed is a reasonably good record. He said the concern was that Ms Spratt continued to ride her mount with the whip when it was shifting ground. He assessed the interference received by the 2 horses on her outside was relatively low. Mr Oatham submitted Ms Spratt erred by not putting the whip away and straightening her mount. Overall he submitted the breach was in the low to mid range and believed an appropriate would be 4 to 5 days suspension.
Ms Spratt accepted Mr Oatham's submissions were correct. Ms Spratt told the Committee she had no firm commitments in the next 7 days.
In response to a question from the Committee, Ms Spratt confirmed she did not intend to ride at Waimate or Dunedin next week.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented. We have adopted 5 riding days as the starting point in considering the term of suspension for this careless riding charge. The mitigating factors are Ms Spratt's admission of the breach, her good record under this Rule, we note that Ms Spratt had not incurred a suspension for careless riding in the last 4 months and finally we assess the interference received by the 2 horses to be low range. The aggravating fact was Ms Spratt continued to ride her mount strongly with the whip and she failed to take any corrective action when it moved out.
The Committee complimented Ms Spratt on her honesty regarding her upcoming South Island commitments.
We assessed the overall level of carelessness to be in the low to mid range.
After taking into account all of the above and placing emphasis on the mitigating factors we independently assess an appropriate penalty is a 4 day suspension.
