As Miss Myers admitted the breach the Committee finds the charge proved.

Penalty:

The Committee grants Miss Myers' request to seek a deferment to her suspension as per Rule 1106(2).

Accordingly, the Committee imposes a suspension on Miss Myers which will commence after racing on 23 December and conclude after racing on 30 December 2013 (4 days).

That period of suspension encompasses meetings at Palmerston North or Ellerslie on December 26, Rotorua on December 27, Ellerslie on December 28, and Taupo on December 30.

Facts:

Following the running of Race 2, Matamata Veterinary Services, an Information was filed pursuant to Rule 638(1) (d). The Informant, Mr Williamson, alleged that Miss R Myers angled her mount SHEEZ ALL HEART inwards near the 300 metres when not sufficiently clear crowding JIMMY HOFFA onto DESCHANEL with both those runners being checked.

Miss Myers acknowledged that she understood the nature of the charge, the Rule and confirmed her admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Oatham identified on the video films passing the 300 metres SHEEZ ALL HEART shifted to the inside of ASADAUSAKAITE to obtain clear running, crowding JIMMY HOFFA (K Myers) on to DESCHANEL (D Johnson) which were both checked and steadied.

Mr Oatham stated the incident was made to look worse because when Miss Myers angled her mount in Mr Bosson was angling his mount SEIZE THE MOMENT out when looking for clear running one off the rail. He stated this was a mitigating factor to the interference. He added when SHEEZ ALL HEART made contact with JIMMY HOFFA the horse aggravated the interference by laying in.

Miss Myers admitted she angled her mount in when not sufficiently clear which caused the interference. She stated there was minor movement from runners on the inside and outside on her which aggravated the situation. She added that her mount was erratic and over reacted to racing in a tight position.

Submissions for Penalty:

Mr Williamson produced Miss Myers' record which showed 2 previous breaches under this Rule in the last 12 months. He described Miss Myers' record as reasonably good for a busy rider. He noted the interference looked reasonably severe but believed there were mitigating factors in Miss Myers' favour which Mr Oatham identified. He submitted a suspension in the 4 to 5 day range.

Miss Myers advised that she had upcoming commitments at New Plymouth on 23 December, and that any period of suspension could commence after that. She asked the Committee to take into account the mitigating factors when imposing penalty.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. The Committee has adopted 5 riding days as the starting point in considering the term of suspension. The mitigating factors are Miss Myers' admission of the breach and her good record as a busy rider in relation to this Rule.

The level of carelessness is assessed as low to mid - range. The Committee accepts there were mitigating factors involved and note there was minor movement by horses racing either side of Miss Myers' mount which contributed slightly to the interference.

After taking into account all the above and placing emphasis on the mitigating factors the Committee considers an appropriate penalty is a 4 day suspension.
