Facts:
Following the running of the DAYAVEG MOBILE PACE an Information was lodged by Stipendiary Steward Mr JM Muirhead against Open Horseman Mr T Mitchell alleging that when driving JANIES GOT A GUN he used his whip excessively inside the final 400 metres.
Rule 869(2)(a) states: No horseman shall during any race use his whip in an unnecessary, excessive or improper manner.
The HRNZ Whip Guidelines applying from 1st December 2016 provide that any use of the whip in excess of 10 times in the final 400 metres of a race shall be excessive.
Mr Mitchell advised the Committee that he admitted the breach and he did not wish to be present at the Hearing.
Mr Muirhead demonstrated the incident by use of the race films and showed where Mr Mitchell used his whip 13 times on JANIES GOT A GUN in the last 400 metres of the race. He did say that there was some respite.
Submissions for Penalty:
Mr Muirhead said that Mr Mitchell is a busy Driver and he has a good record under this Rule. He said that notwithstanding the starting point penalties under the JCA Guidelines a fine of $300.00 would be appropriate.
Reasons for Penalty:
The Committee viewed the race films and confirmed the number of strikes with the whip. It is excessive but the mediating points are that there was some respite, Mr Mitchell is a busy Driver and he has a good record under this Rule and further he admitted the breach.
The Committee believes that the fine submitted by Mr Muirhead is appropriate.
