As Mrs Tyler admitted the breach it is found to be proved. 

Penalty:

We suspend Mrs Tyler from riding at the end of today’s meeting up to and including 13 March. This is 3 South Island days. 

Facts:

Mr Davidson alleged that Mrs Tyler failed to ride out FANTAMO in race 6, the PAUL FERRIS MEMORIAL TROPHY until the end of the race when there was a reasonable chance of the horse running in a higher placing.

Rule 636(1) states:

(d) being the Rider of a horse in a Race, must ride his horse out to the end of the Race if there is a reasonable chance of it running into a position for which there is prize money to be awarded or a dividend to be declared;

Mr Davidson demonstrated that some two and half strides from the winning post Mrs Tyler relaxed her ride when in 4th position. NORAH finished on down the outside of the track and took 4th place off FANTAMO right on the line. The margin was a nose. Mr Davidson emphasised there were no queries with respect to Mrs Tyler’s ride until that point in the race as she had been pushing her mount forward.

Mrs Tyler explained she had a serious weight problem and had had to waste hard to get down to her riding weight. She said she had severely limited her food and fluid intake, and as there was no sauna available to her, she had been running in a wet suit. She also said she had a personal issue which had greatly inconvenienced her during the day. She said by the end of the race she was completely spent and had become very weak and she thought she might have blacked out for a moment. She added she only rode today because they had a large team and were unable to get alternative riders.

Submissions for Penalty:

Mr Davidson stated that he accepted Mrs Tyler’s explanation. He said she had 6 rides on the day and had ridden the winners of the 1st 2 races. He emphasised that the horse in the 1st had been far from the kindest ride for her, in that she was almost dislodged just after the start. He said Mrs Tyler had an obligation to ride her mount to the winning post and he believed her failure to do so had likely cost the horse 4th placing.

Mr Davidson produced the respondent’s record which was clear under this Rule. He said he was not surprised at this as Mrs Tyler was a successful and aggressive rider. He said fines of between $400 to $600 had been imposed for similar breaches and suspensions of up to 6 days, although those had been in the North Island. He submitted a lesser suspension was appropriate.

Mrs Tyler said she knew she had to get her weight under control and she believed a period on the side-lines would help her in this regard. She thus asked that the Committee consider a suspension.

Reasons for Penalty:

Failing to ride out has to be considered a serious breach of the Rules as it may cost the connections of the horse and those members of the public who have invested on the horse. On this occasion Mrs Tyler’s actions probably cost FANTAMO 4th placing. We accept there are strong and unusual mitigating factors in this instance. Credit is also to be given for the respondent’s prompt admission of the breach, her clear record under this Rule and that she is an apprentice jockey who rides solely in the South Island.
