Mr Ray explained that Mr Hamilton had believed the track was a dead 4 and was unaware that the latest reading was a good 3. Mr Hamilton, after walking the track, believed the track was too firm for the horse. The stewards permitted him to late scratch the horse.

Mr Ray said Mr Hamilton had “previously come to notice” under this rule. He observed a fine of $150 had been imposed upon Mr Harris in similar circumstances at Blenheim recently.
Reasons for Penalty:
There were no horses balloted out so no horse was denied a start but punters who bet early on the race would have been inconvenienced. Having reference to comparable penalties, we believe the submission by Mr Ray is apt in the circumstances of this case.
