Facts:
Following the running of Race 2 (Clifton Builder/Summit Electrical Maiden (1200m) Ford), Information No. A9210 was filed with the Judicial Committee. The Informant alleged that Mr Turner (MAGICELLA) ) had allowed his mount to shift ground in the home straight and cause checks to ALL IN BLOOM and ILLIE’O’CEIRIN.
Rule 638 (1)(d) provides:
A rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless
Mr Turner said that he understood the Rule and confirmed he admitted the breach.
Stipendiary Steward, Mr Whiterod identified the three horses on all film replays and said that early in the run home Mr Turner was racing close to the inside rail and just behind the pace. He said Mr Turner was riding with vigour when, just inside the 75m, he angled his horse out sharply causing checks to ALL IN BLOOM and ILLIE O’CEIRIN.
Mr Turner in response, said he was attempting to gain clear running to finish off late and, when he angled out, his horse over-reacted. He said MAGICELLA’S racing gear included cheek burrs which may have resulted in it over-reacting.
Submissions for Penalty:
Mr Balcombe viewed the interference to be in the mid-range with an aggravating factor being that the interference extinguished the chances of the two horses checked, even though they were battling away at the time.
Mr Balcombe assessed Mr Turner as a North Island rider who rode on the flat and over jumps regularly in the Central Districts, Waikato and Auckland districts. He said Mr Turner had a good recent riding record under the careless riding rules, his most recent breach being February 18th this year when he was suspended for four riding days.
Reasons for Penalty:
In fixing quantum of penalty, the Committee had regard to the JCA starting point of 5-riding days suspension for careless riding. The Committee placed the carelessness in the mid-range category as Mr Turner’s actions caused two horses to suffer bad checks. This justifies an uplift of one day to a six day riding suspension.
The mitigating matters were Mr Turner’s good record and that he admitted the breach for which he is afforded a discount of one day.
