Facts:
Following the running of Race 8, Sonia & Garry Thompson Rating 65, an information was filed by Chief Stipendiary Steward, Mr J P Oatham, against Licensed Jockey (Class A), Ms K Williams, alleging that Ms Williams, as the rider of FINAL SAY in the race, she “permitted her mount to shift outwards near the 300 metres when not clear of PENDLETON (J L Waddell) which was checked.
Ms Williams was present at the hearing of the information and she indicated that she admitted the breach. Rule 638 provides as follows:
(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless.
Mr Oatham had Mr J M McLaughlin, Stipendiary Steward, show video replays of the incident with approximately 300 metres to run. He pointed out FINAL SAY, ridden by Ms Williams, racing in the last few runners as the field entered the final straight. PENDLETON, ridden by Mr WADDELL, was also racing in the last few to the outside of Ms Williams. Ms Williams, held up and looking for racing room, then angled out across the heels of another runner and continued coming out and, in doing so, checked Mr Waddell’s mount.
Ms Williams said that she felt that the runner in front of her had marginally moved out and contributed. She had not been aware of Mr Waddell having been there and was not aware of what had happened until she had viewed the video. However, she did admit the breach, she said.
Submissions for Penalty:
Mr Oatham said that Ms Williams’ record showed two breaches in the last 12 months – 27 November 2016 at Otago (3 days’ suspension for an above mid-range breach) and at Canterbury on 11 February 2017 (2 days for a low-end breach). Ms Williams’ record could be regarded as being a neutral factor, he submitted. The Stewards regarded the level of carelessness on this occasion as being below mid-range, and a suspension in line with that would be appropriate, Mr Oatham said.
Ms Williams asked the Committee if her suspension could start immediately. She did not wish to add anything.
Reasons for Penalty:
In determining penalty, the Committee took the starting point of a 3 days’ suspension for a South Island rider, as recommended in the Penalty Guide. The Committee could find no aggravating factors, so there was no need to increase that starting point. The breach was no worse than mid-range in the Committee’s view, and Ms Williams’ riding record was a neutral factor.
The sole mitigating factor was Ms Williams’ admission of the breach for which the Committee allowed a discount of 1 day.
