The Protest is upheld and ALL OVER THE STARS is disqualified from the race.

The amended placings are now : first (14) O'DRISCOLL

                                                   third (10) MAJESTIC GAL

                                                   fourth (13) TE KOUKA BREEZE

                                                   fifth (11) IZINTHEZONE

It is ordered that dividends and stakes are paid in accordance with the amended placings.

Facts:

Following the running of the CROMBIE LOCKWOOD INSURANCE 3YO+ HANDICAP TROT an Information instigating a Protest was lodged by Stipendiary Steward Mr JM Muirhead against the 2nd placing of ALL OVER THE STARS on the grounds that it galloped in excess of 50 metres in the last 200 metres of the race.

Rule 870(3) provides: that any horse which breaks from its gait during a race must promptly return to its correct gait.

Section B of the Breaking Horses Regulations provides: that any horse which breaks in the last 200 metres of a race and continues in a break for a distance of 50 metres or greater shall be in breach of Rule 870(3).

Ms A Matthews the Trainer of ALL OVER THE STARS signed the Information and admitted the breach.

Mr Muirhead demonstrated the incident by use of the race films and showed where ALL OVER THE STARS broke at about 80 metres from the finish and continued in a gallop to the Winning Post.

Mr Muirhead submitted that as ALL OVER THE STARS had galloped in excess of 50 metres it was in breach of Rule 870(3) and should be disqualified from the race.
