Mr Renault, Stipendiary Steward, alleged that Mr G Telfer used his whip in a manner which the stewards deemed to be excessive when driving SHARE THE JOY in the run home.
Facts:
Mr Renault demonstrated on the videos that Mr Telfer when driving SHARE THE JOY had continuously used the whip from the 400 metres. However, he agreed with the respondent’s contention that there were at least 2 pauses, but these he emphasised were brief.
Mr Telfer alleged there were 3 or 4 brief pauses.
Submissions for Penalty:
Mr Renault produced the respondent’s record, which was clear under this rule this season. He said Mr Telfer had had 141 lifetime drives, including 37 last season and 19 thus far this season. He submitted a fine of $200 to $250 was appropriate.
Mr Telfer asked for a lesser fine.
Reasons for Penalty:
We agree there were at least 20 strikes with the whip in the run home. There was the odd pause but these were momentary. We give credit for the respondent’s very good record and admission of the breach.
