The Protest is upheld and DJOKOVIC is disqualified from the race and the amended placings are now :

First (4) ANY OLD WAY

Second (7) VULCAN

Third (3) VERY PERSUASIVE

Fourth (6) BARRY

Fifth (5) REGAL PETITE

It is ordered that Stakes be paid in accordance with the amended placings.

Facts:

Following the running of the FATHER'S DAY IN THE ALEX BAR & EATERY HCP TROT an Information instigating a Protest was lodged by Stipendiary Steward Mr S Mulcay against the 5th placing of DJOKOVIC on the grounds that it broke and galloped in excess of 50 metres inside the final 200 metres.

Dr LS Chin the Trainer/Driver and part Owner of DJOKOVIC endorsed the Information " I do not contest the Protest " and he also elected not to be present at the Hearing.

Part (b) of the Breaking Horse Regulations provides: that any horse that breaks from its gait in the final 200 metres of a race and continues in a break for a distance of 50 metres or more shall be in breach of Rule 870(3) and may be either relegated or disqualified from the Race.

Stipendiary Steward Mr B Jones demonstrated the incident by use of the race films and showed where DJOKOVIC broke in the home straight and galloped for approximately 140 metres.

Mr Jones submitted that DJOKOVIC should be disqualified from the race.
