Facts:
After the completion of race 9 at Woodville, (THE ALL DIAMONDS ZEDACE SYNDICATE 2100), a protest was lodged by the stipendiary stewards alleging that BELLA'S DELIGHT caused interference to RED MAFIA in the home straight. The provisional placings as called by the judge were:
1st - BELLA'S DELIGHT
2nd - RED MAFIA
The official margin between first and second was a nose.
Rule 642 (1) reads If a placed horse or its rider causes interference within the meaning of this rule 642(1) to another placed horse and the judicial committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred they may place the first mentioned horse immediately after the horse interfered with.
Submissions for Decision:
Mr Goodwin, using the available films took the committee through the incident. Upon straightening up in the run to the judge BELLA'S DELIGHT shifted out and onto the running line of RED MAFIA impeding its progress. Horses further out were also affected by BELLA'S DELIGHT's outward movement. RED MAFIA was denied a run at least twice. Although jockey M Singh did attempt to straighten BELLA'S DELIGHT briefly the outward movement continued down the home straight.
Miss E Farr, jockey of RED MAFIA under questioning from Mr Goodwin told the committee she was entitled to be where she was and was mounting her run. She was pushed three wide off the fence to about five or six wide, got squeezed and lost momentum. Her mount was struck on the head at least twice during the incident. She reiterated that her line was dictated for quite a distance down the straight and the horse concerned was still pushing her out. She was adamant that she would have won the race and reminded the committee the margin was only a nose.
Mr Scott had no questions and using the available films he informed the committee that the horses further out, shifting inwards onto RED MAFIA caused the incident. He believed there was no gap for RED MAFIA and that BELLA'S DELIGHT kept her line.
Jockey M Singh was also of the opinion that the incident came about by the movement of other horses but upon being asked to point this out on the head on film was unable to do so with any clarity.
Mr T Burn commented that it was his opinion that RED MAFIA was denied a clear run to the line.
Mr Goodwin, in summing up stressed again that interference did occur early in the run home and although jockey Singh did briefly attempt to straighten RED MAFIA was buffeted quite a way down the straight. Jockey Singh's vigorous riding caused the gap that Miss Farr was entitled to, to abruptly close.

The films clearly showed that upon straightening BELLA'S DELIGHT moved inwards causing tightening to RED MAFIA and two other horses. RED MAFIA was entitled to be where he was and was mounting his run when BELLA'S DELIGHT took his line. Miss Farr had to take hold and contact between the two horses occurred. Her mount was pushed five or six horse widths away from the fence and although there was a slight easing of the pressure for a few strides her line was dictated to for quite some distance. The committee was of the opinion that upon getting balanced RED MAFIA was taking ground off BELLA'S DELIGHT in the run to the line and was mindful of the official margin (a nose).
