Rule 870 (3) Any Horse which breaks from its gait shall promptly regain its gait., Breaking Horses Regulations:, (b) Any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870(3), in that it has failed to promptly regain its proper gait., Where a protest has been duly lodged against the placing of an offending horse, the Judicial Committee shall either;, (i)relegate such horse under Rule 870(4) to behind any other horse in respect of which an advantage may have been gained; or, (ii) disqualify it from the race under Rule 1003(2).

GLENELEVEN is disqualified according from its 4th placing in the "Sunny Ruby 3 Year Old Filly of the Year Trot".

 Amended placings are:

 1st - TRIAL SEPARATION (3)

2nd - NATIVES BRITE GEM (5)

3rd - DIANA HARBOUR

4th - CHINA EXPRESS

5th - CHIVASION

Dividends and stakes are to be paid in accordance with the amended placings.

Facts:

Following the running of the "Sunny Ruby HRNZ 3 Year Old Filly of the Year Trot", a protest was lodged by the Stipendiary Stewards alleging that GLENELEVEN had galloped in excess of 50 metres in the final 200 metres of the race. GLENELEVEN finished in 4th position and was not "lapped on" by any other horse.

The video coverage was shown to Mr Smith, the driver of GLENELEVEN in the presence of the Judicial Committee. Mr Smith confirmed that he was authorised by the connections of GLENELEVEN  to speak on their behalf.

After seeing the video coverage Mr Smith was satisfied that his horse had galloped in excess of 50 metres in the final 200 metres and accordingly advised the hearing that he did not contest the protest.

Submissions for Decision:

Mr Quirk submitted that the evidence was clear, and requested that GLENELEVEN  be disqualified.

Reasons for Decision:

The breach of the rule and the Breaking Horses regulations was obvious. GLENELEVEN galloped for more than 50 metres in the final 200 metres of the race. This was clearly established by reference to the marker pegs.
