Mr Barclay was fined the sum of $200.00 and reminded of his professional obligations.
Charge:
Following the running of Race 10 The Lamb Drives Supporters Mobile Pace an information was lodged by Stipendiary Steward Mr C J Allison alleging that under rule 869(2)(b) Mr B Barclay (Danbrae) with approximately 200 metres to run struck another runner Acting Up (B McLellan).
Mr Barclay admitted the breach.
Facts:
Mr Allison showed the head on and side on video films of the alleged incident which occurred about the 200 metre mark to run.
Mr Allison stated that Mr McLellan had flicked his whip striking the sulky cart of Acting Up (B McLellan) who was racing along side him at the back of the field at the time.
Mr Allison stated that neither horse was in the position of running in a dividend or stake bearing place.
Submissions for Decision:
Mr B Barclay (Danbrae) stated that his action was one of frustration and one that he regretted.
His horse Danbrae had been racing erratically and had been difficult to drive throughout the race.
Mr McLellan (Acting Up) stated that his horse had also been difficult to drive and that Mr Barclay's action was one he believed to ensure the horses did not come into contact as they were racing closely together.
Reasons for Decision:
The Committee was satisfied a clear breach of the rule had occurred, the video films were conclusive and clearly showed Mr Barclay striking the sulky of Acting Up (B McLellan).
Submissions for Penalty:
Mr Allison submitted that Mr Barclay had an outstanding record and that he also believed Mr Barclay's actions were a result of frustration with the racing manners of Danbrae.
Mr Allison also stated that Mr Barclay freely admitted the breach and regretted his actions.
Mr Barclay stated that he was disappointed in himself, the action he took and he understood that it was well below what is required of a Senior Horseman.
Reasons for Penalty:
The Committee considered all of the submissions put before it. It was our opinion that a monetary penalty was sufficient on this occasion.
Mr Barclay has reacted due to a sense of frustration to his horse's racing manners and his actions were clearly out of character.
The Committee also gave Mr Barclay credit for his outstanding driving record and his early admittance of the breach.
