Facts:
Following the running of the DMI PLUMBING HANDICAP TROT an Information instigating a Protest was lodged by Senior Stipendiary Steward Mr S Mulcay against the 4th placing of LOLLIEPROP (horse number 1) on the grounds that it galloped excessively during the middle stages of the race.
Rule 870(3) provides: Any horse which breaks from its gait shall promptly regain its proper gait.
Promptly returning to its proper gait is specified in the Breaking Horses Regulations where in part (a) it provides: Any horse which breaks from its gait either at the start or during the running of any race and continues on in a break for a distance of 150 metres or greater , shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its proper gait.
The last part of the Breaking Horses Regulations gives the Committee power under Rule 1003(2) to disqualify from the race any horse found to be in breach of the Rule.
Mr P Ferguson the Driver of LOLLIEPROP advised that he was authorised to represent the Owners and Trainer of the horse and endorsed the Information to the effect that the Protest was not contested and he did not wish to be present at the Hearing.
Mr Mulcay demonstrated the incident by use of the race films and showed where LOLLIEPROP was racing 3 back on the inside and that at about the 1450 metres mark it went into a gallop and continued in a gallop until about the 1100 metres mark.
