The Protest is therefore upheld and ROUEN is disqualified from the race.

The amended placings are now :

First - (6) INKYROE

Second - (1) CHEVRONS SWEETHEART

Third - (4) I'M A SPECIAL

Fourth - (2) SPEEDY LAVROS

It is ordered that stakes are paid in accordance with the amended placings.

Facts:

Following the running of the THAI NIGHT 16TH SEPTEMBER "@55 PER PERSON" TROT an Information instigating a Protest was lodged by Stipendiary Steward Mr S Mulcay against the 5th placing of ROUEN on the grounds that it broke in the early stages of the race and galloped in excess of 150 metres and failed to regain its proper gait.

Rule 870(3) provides: that any horse which breaks from its gait during the running of a race shall promptly regain its proper gait.

The Breaking Horses Regulations provide: that any horse which breaks from its proper gait during a race and gallops in excess of 150 metres shall be in breach of Rule 870(3).

Mr B Hackett co-Trainer of ROUEN endorsed the Information with the words " I do not contest the Protest and do not wish to be present at the Hearing ".

Mr Mulcay demonstrated the incident by use of the race films and showed where ROUEN broke from its gait and galloped in excess of 150 metres. He said that it was more 200 to 250 metres.

Submissions for Decision:

Mr Mulcay submitted that as ROUEN had galloped in excess of 150 metres it was therefore in breach of Rule 870(3) and should be disqualified from the race.
