The protest was upheld and the third placed horse by the Judge ROBS IDEAL was relegated from third to fourth placing. LIVELY HERO the fourth placed horse was promoted to third placing.

Facts:

At the conclusion of Race 4 The Centrepoint- South City Liquorland Mobile Pace a protest was lodged by Stipendiary Steward Mr C J Allison alleging that the third placed horse by the Judge ROBS IDEAL (A Sanderson) ran out in the home straight forcing LIVELY HERO (M Williamson) to race wider on the track during the run home.

Submissions for Decision:

Stipendiary Steward Mr Allison showed the Committee several video clips of the alleged incident highlighting in his opinion, ROBS IDEAL moving out from the top of the straight pushing LIVELY HERO wider on the track.

Mr Allison stated that LIVELY HERO was pushed at least five cart widths across the track.

Mr Allison also stated that the two horses almost came in contact halfway down the straight.

Mr Allison said the margin between third and fourth being a head was also significant.

Mr Sanderson stated that it was obvious his horse ROBS IDEAL had run out, but maintained that Mr Williamson was not forced to cover any extra ground.

Mr Barclay assisting Mr Sanderson stated that he did not think LIVELY HERO was ever going to beat ROBS IDEAL.

Mr Williamson (LIVELY HERO) stated that he had covered extra ground at least five cart widths and that he would have finished third.

Mr Williamson also stated that he had to check off the back of ROBS IDEAL at the straight entrance losing his momentum.

Mr Knight (Trainer of LIVELY HERO) reinforced Mr Williamson's comments stating that he firmly believed his horse would have finished third.

Reasons for Decision:

The Committee was satisfied that LIVELY HERO was forced over extra ground and in our opinion at least five cart widths from the top of the straight to the winning post. The margin of a head between the third and fourth horse at the end of the race was very significant.

Thus we find the protest proved.
