Accordingly, Ms Spratt had her license to ride in races suspended for a period to commence after racing on 27 April and conclude after racing on 8 May 2019.
Facts:
Following the running of race 3, Arawa Park Lounges For Hire 1400, an Information was filed pursuant to Rule 638 (1)(d).The Informant, Mr Jones alleged that Ms Spratt directed her mount outwards when not sufficiently clear hampering VALHEXA near the 1100 metres.
Ms Spratt said that she understood the Rule and confirmed her admission of the breach.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Williamson demonstrated the incident using the available video footage. He identified that Ms Spratt directed her mount MEXICAN TYCOON outwards near the 1100 metres when there was no run available to do so. As a result that runner made contact with VALHEXA which was hampered.
Ms Spratt said that she was wanting to stay off the fence and became awkwardly placed on the heels of HELENA BABY. She accepted that her mount made contact with VALHEXA.
Submissions for Penalty:
Mr Jones produced Ms Spratt’s record which showed 1previous breach of this Rule in the last 12 months. He said to Ms Spratt’s credit she admitted the breach and her record was good. He said the level of carelessness was midrange because Ms Spratt was only a head in front of VALHEXA when she shifted ground.
Ms Spratt advised that she had engagements at Te Rapa on 27 April and any proposed suspension could start after that date. She asked the Committee to take into account her admission of the breach and her good record.
Reasons for Penalty:
The Committee considered all the evidence and submissions presented.
It was evident on the video footage that Ms Spratt directed her mount outwards near the 1100 metres when only a head in advance of VALHEXA. As a consequence that runner was hampered and forced wider on the track. In addition we observed that JUST KATE checked off VALHEXA’s heels and was also hampered.
The Committee deemed the level of carelessness displayed by Ms Spratt was midrange.
The JCA Penalty Guide starting point for midrange carelessness is 8 national riding days which was adopted.
The mitigating factors were Ms Spratt’s admission of the breach and her good record. For these collective factors she was afforded a 1 day reduction in penalty.
After taking into account all the above factors the Committee considered that an appropriate suspension was 7 days.
