Facts:
Following the running of Race 1, Teltrac Premier, an information was filed by Chief Stipendiary Steward, Mr J P Oatham, against Licensed Apprentice Jockey (Class B), Mr S R F Weatherley, alleging that Mr Weatherley, as the rider of LIAM in the race, “permitted his mount to shift inwards near the 300 metres when not fully clear of DOCKET (T N Harris).
Mr Weatherley was present at the hearing of the information and he indicated that he admitted the breach. Mr Weatherley was assisted at the hearing by Apprentice Jockey Mentor, Mr D M Walsh.
Rule 638 provides as follows:
(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless.
Mr M R Davidson, Stipendiary Steward, had Manager of Stewards, Mr N G McIntyre, show the incident on side-on, head-on and rear-on video replays. He pointed out LIAM, ridden by Mr Weatherley, racing behind the leader HAVANA HEIGHTS (S T Collett) with DOCKET (T N Harris) racing on Mr Weatherley’s inner. Approaching the 300 metres, Mr Weatherley was denied a clear run. He then shifted in off the back of HAVANA HEIGHTS when not clear of Mr Harris and, as a result, Mr Harris had to take a hold of his mount and lost his position, Mr McIntyre said.
Mr Weatherley said that his mount had been travelling well. He said that there was “half a run” available, but he accepted that he should have waited longer but had “jumped the gun”, as was clear from the replays. It was a misjudgement on his part, he said.
Mr Walsh submitted that DOCKET was just starting to weaken and a run would be likely to have presented itself, had Mr Weatherley waited for a few more strides.
Mr Davidson, asked by the Committee, said that the breach was low-mid range, in the view of Stewards.
Submissions for Penalty:
Mr Davidson told the Committee that Mr Weatherley has a clear record since returning to New Zealand from Australia on 3 August 2019. He has had 232 rides since returning and, therefore, Stewards saw his record as being a good one. He has also admitted the breach.
Mr Davidson referred to the Penalty Guide which provided a starting point, for a low-to-mid range breach, of a 7 national riding days suspension.
Mr Weatherley advised that he had no riding engagements in the next seven days and, therefore, he did not seek a deferment of suspension.
Mr Walsh said that Mr Weatherley has had a large number of rides since returning to New Zealand and he has been riding extremely well.
Reasons for Penalty:
The Committee agreed with Mr Davidson that the breach is at the low-to-mid end of the scale. Therefore, the Committee adopted the starting point for a low-mid range breach of the Rule of a 7-days suspension as per the Penalty Guide.
Mitigating factors are Mr Weatherley’s very good record and his very frank admission of the breach and, for those factors, we have allowed him a discount of 1 day from the starting point of 7 days.
