Mr Hamilton admitted the charge and it is found proved.

Penalty:

Mr Hamilton is fined $850 and reminded of his obligations under the Rules of Thoroughbred Racing NZ.

Facts:

Following the running of race 7, the ADMIN EXPRESS MAIDEN 1600 an information was lodged by Stipendiary Steward, Mr M Davidson alleging Licensed Trainer, Mr M Hamilton was in breach of Rule 614 (2) “…that when being saddled PAW PATROL has been saddled without the lead bag and when weighing in the rider was 0.9kg light with the horse being disqualified…”.

Mr Hamilton admitted the charge and appeared at the hearing.

Mr Davidson stated that when Mr Jones (rider of PAW PATROL) weighed in he could not draw the correct weight of 58.5kg. He weighed in 0.9kg light at 57.6kg. It was found that the lead bag had not been placed in the saddle in the stable area when the horse was being saddled.

Mr Hamilton admitted he had saddled PAW PATROL and that he had forgotten to attach the lead bag. He said the Plate Inspector had not picked up the bag was missing also. 

Submissions for Penalty:

Mr Davidson stated Mr Hamilton had no previous charge under this Rule and had admitted the breach. Previous breaches of the Rule where the error had been found at inspection were $500 fines. He could only recall two previous breaches of the Rule in the last five years where horses had raced. Fines ranged from $850 to $1000. He also stated that there were procedures in place to check gear and he was disappointed it was not picked up on this occasion. However, the connections, jockey and the betting public were all out of pocket because of the error. The Stewards were seeking a fine of $1000.

Mr Hamilton stated he had admitted the charge and it was his first offence under the Rule. He was also a part owner and the trainer of PAW PATROL and he had already missed out on a winning stake. He accepted a fine was inevitable.

Previous admitted breaches of the Rule where the error was found on pre race inspection were $500. The aggravating features of this incident are that PAW PATROL won the race and was subsequently disqualified. There is also a financial lose to the connections of the horse, the jockey and the betting public. The committee takes a starting point of $1000. Credit is given for Mr Hamilton’s admission of the breach and his clear remorse at the error. We also note that the error was not picked up during pre race inspection.
