Facts:
Following the running of race 4 the Diamond Syndicate Maiden 2200m stewards charged Mr B Hong with a breach of excessive use of the whip in that he “…B Hong (PEGGY STEWART) used his whip excessively prior to the 100m.”
Rule 638 (3) (b) (ii) reads: A Rider shall not:
(b) strike a horse with a whip in a manner or to an extent which is:
(i) unnecessary (ii) or excessive (iii) or improper
The guidelines read: Without affecting the generality of Rule 638(3)(b), a rider may be penalised if their whip use is outside of the following guidelines: Inside the final 600 metres of a race, official trial or jump-out a horse may be struck with the drawn whip up to five times after which the rider must cease their use of the whip for a minimum of five strides before striking the horse again with the drawn whip, with this restriction to apply prior to the final 100 metres. The whip may then be used at the rider’s discretion until the winning post is reached.
Mr McLaughlin, with the aid of the videos pointed out the relevant position of Peggy Stewart in the home straight. He said Peggy Stewart was improving on the inner when, with approximately 200m to run, Mr Hong drew his stick and used his whip 11 times prior to the 100m mark. He said Mr Hong’s use of the whip did not include the required break of five strides.
Mr Walsh stated that Mr Hong had made an error when attempting to improve his position. Mr Hong stated he was at fault.

Mr Davidson said Mr Hong had two breaches of the rule, both prior to Christmas, at Ashburton and Tapanui with eight and six day’s suspension respectively. He had a good record since the beginning of the year and stewards were seeking a suspension of 6-7 days.
Mr Walsh said Mr Hong had been riding for three seasons with an increasing number of rides. He said he’d ridden about 100 times this year without incident. Mr Hong accepted a suspension was inevitable and was not seeking a deferment.
