Facts:
Following the running of Race 3, Jubilee Park Mobile Pace, an Information was filed Instigating a Protest pursuant to Rule 869(4A).The Informant, Mr Muirhead, alleged that 2nd placed TWENTYNINE TWELVE (Z Butcher) stumbled approaching the 900 metres causing a severe check to 3rd placed DREAM TO SHARE ( M McKendry).
The official margin between 2nd and 3rd was ½ a length.
The protest was contested and their respective Drivers confirmed they were representing the connections of TWENTYNINE TWELVE and DREAM TO SHARE.
Rule 869(4) provides: "No horse shall during any race do anything which interferes or is likely to interfere with any other horse or its progress.
Rule 869A (2) provides " When a placed horse or its driver causes interference to another placed horse and the Judicial Committee is satisfied that the horse interfered with would have finished ahead the horse that, or whose driver, caused the interference the Judicial Committee must, in addition to any other penalty that may be imposed, place the horse that, or whose driver, caused the interference immediately after the horse interfered with".

Mr Muirhead demonstrated the incident by use of the available video footage.
Mr Muirhead submitted that approaching the final 900 metres TWENTYNINE TWELEVE stumbled when racing in a 3 wide position which resulted in LYNTON CREEK and DREAM TO SHARE being checked. He said the incident cost DREAM TO SHARE 3 to 4 lengths and in the Stewards view a better placing.
Mr Butcher submitted that the incident happened too far from the finish. He added that his horse ended up 4 wide and doing more work after it stumbled.
In response to a question from the Committee, Mr Butcher acknowledged that he caused interference to DREAM TO SHARE but he reiterated the incident occurred a long way from home.
Mr McKendry submitted that he noticed that TWENTYNINE TWELVE dip and he thought the horse was going to go down. He said this caused his horse to go out a bit and conceded that DREAM TO SHARE was unlucky.
Mr Muirhead submitted that the Stewards were seeking the relegation of TWENTYNINE TWELEVE to 3rd place.
Reasons for Decision:
The Committee carefully considered all of the submissions presented. After reviewing the incident we established that TWENTYNINE TWELVE dipped and stumbled near the 900 metres. This resulted in DREAM TO SHARE being checked and its Driver having to take evasive action. The head – on film showed that DREAM TO SHARE veered out sharply and lost approximately 3 lengths due to the interference and its progress was certainly impeded. It was significant that over the closing stages of the race DREAM TO SHARE was taking ground off TWENTYNINE TWELVE to be beaten ½ a length.
After taking into account all the above factors the Committee is of the opinion that DREAM TO SHARE would have beaten TWENTYNINE TWELVE had such interference not occurred.
