As Mr Nolan admitted the breach we find the charge proved.

Penalty:

Accordingly, we impose a suspension on Mr Nolan which will commence after racing on 18 January and conclude after racing on 26 January 2014 (4 days)

The penalty did not include Wellington on January 20 because the rider declarations had closed.

The penalty did not include any South Island meetings as Mr Nolan confirmed that he did not intend riding there.

Facts:

Following the running of Race 1, Price Racing 2000, an Information was filed pursuant to Rule 638(1) (d). The Informant, Mr Coles, alleged that near the 250 metres, Mr Nolan allowed his mount CAJERO to shift out under pressure, crowding ZULU BOY (D Johnson) onto MUTT WILLIAMS (R Smyth) which was forced across the heels, having to check.

Mr Nolan acknowledged that he understood the nature of the charge, the Rule and confirmed his admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Robinson identified on the films Mr Nolan riding his mount CAJERO forward near the 250 metres. Shortly after this point Mr Nolan angled his mount outwards when not sufficiently clear of ZULU BOY who in turn put pressure on MUTT WILLIAMS which was checked.

Mr Nolan told the Committee that CAJERO was a big horse who weakened and drifted out when placed under pressure. He acknowledged this caused minor checks to 2 horses on his outside.

Submissions for Penalty:

Mr Coles produced Mr Nolan’s record which showed 1previous breach under this Rule in the last 12 months. He said Mr Nolan had an excellent record and ought to be given credit for his early admission of the breach. He submitted a suspension at the low end would be appropriate and noted Mr Nolan rode only in the North Island.

Mr Nolan advised that he had upcoming commitments at Counties on 18 January, and any proposed suspension could commence after that date.

Mr Nolan confirmed that he rode only in the North Island.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. We have adopted 5 riding days as the starting point in considering the term of suspension. The mitigating factors are Mr Nolan’s admission of the breach, the level of carelessness we assess as low end and his very good record in relation to this Rule.

We note Mr Nolan was not the required distance clear when shifting out.

After taking into account all the above factors we consider an appropriate penalty is a 4 day suspension.
