As Ms Spratt admitted the breach we find the charge proved.
Penalty:
We grant Ms Spratt’s request to seek a deferment to her suspension as per Rule 1106(2).
Accordingly, we impose a suspension on Ms Spratt which will commence after racing on January 5 and conclude after racing on January 13 (6 North Island days).
Facts:
Following the running of Race 4, 2013 / 2014 Dunstan Feeds Championship Final, an Information was filed pursuant to Rule 638(1) (d). The Informant, Mr Oatham, alleged that near the 1600 metres Ms Spratt permitted her mount JAGERSFONTEIN to shift in, dictating HER TO ETERNITY inwards into the line of ARIZONA JAZZ which was severely checked.
Ms Spratt acknowledged that she understood the nature of the charge, the Rule and confirmed her admission of the breach.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Neal identified on the films near the 1600 metres JAGERSFONTEIN improved 3 wide to the outside of HER TO ETERNITY with ARIZONA JAZZ racing adjacent to the rail. He pointed out that JAGERSFONTEIN shifted onto and dictated HER TO ETERNITY which subsequently checked ARIZONA JAZZ. He said the impact on ARIZONA JAZZ was severe and other horses we also affected. Mr Neal added Ms Spratt was not the required distance clear when shifting in.
Ms Spratt told the Committee that she tried to ease of HER TO ETERNITY as soon as she could but conceded it was too late.
Submissions for Penalty:
Mr Oatham produced Ms Spratt record which showed 4 previous breaches under this Rule in the last 12 months, the most recent being on 26.10.13 at Ellerslie which attracted a penalty of 6 days. He said that the level of carelessness was in the mid to high range and the interference was severe, impacting mostly on ARIZONA JAZZ but noted other runners were affected. He added the Committee ought to consider the stake of the Race ($75,000) and the Stewards’ submit a penalty of not less than 6 days.
Mr Oatham advised the Committee that the rider declarations for Otaki on January 5 had closed.
Ms Spratt advised that she had commitments up to and including January 4 and sought a deferment to any proposed suspension. Ms Spratt acknowledged that rider declarations had closed for January 5 and she accepted any proposed suspension would not include that meeting.
Ms Spratt submitted to the Committee that her previous recent breaches which had incurred 6 days occurred in a Group 2 race. She also added that she felt that ARIZONA JAZZ had over reacted to the interference and it looked worse than it really was.
Ms Spratt confirmed that she had no intention to ride at Reefton on January 8.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented. We have adopted 5 riding days as the starting point in considering the term of suspension. The mitigating fact is Ms Spratt’s admission of the breach. The aggravating factors are Ms Spratt’s below average record, this breach being the 5th in a 12 month period. The Committee reviewed the film and assessed the level of carelessness as mid – range but determined the impact on ARIZONA JAZZ which hit the running rail as severe. We note the check resulted in Mr Du Plessis being unbalanced in the saddle which caused ARIZONA JAZZ to lose momentum. Also hampered were BEAUTY PERCEPTION and LION RED.
We note this breach occurred in a race carrying a stake of $75,000. We also note that Ms Spratt’s most recent breach on 26.10.13 which attracted a 6 day suspension did not occur in a Group 2 race.
After taking into account all the above factors we consider an appropriate penalty is a 6 day suspension.
