As Mr Yanagida admitted the breach the Committee found the charge proved.

Penalty:

The Committee granted Mr Yanagida a deferment to his suspension pursuant to Rule 1106(2). Accordingly, Mr Yanagida’s licence to ride in races is suspended for a period of 6 days commencing after racing at Rotorua on 2 December 2020 and concluding after racing at Tauranga on 11 December 2020.

Facts:

This charge arises from the running of Race No 3, the Dunstan Feeds Stayers Championship Qualifier 2200 metres. Senior Stipendiary Steward Mr Williamson filed an Information pursuant to Rule 638(1)(d) alleging the rider of ISKANDER (Mr Yanagida), allowed his mount to shift in passing the 150 metres when not sufficiently clear of RISING ROAD (J Fawcett) which was crowded and hampered.

Mr Yanagida acknowledged he understood the Rule and confirmed his admission of the breach. He was assisted at the hearing by the Northern Rider Mentor Mr N Harris.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Using all available video footage Stipendiary Steward Mr Coles demonstrated the incident and identified all horses and riders concerned. He told the Committee that approaching the 150-metre mark ISKANDER was racing on the outer of RISING ROAD. He said that ISKANDER commenced to shift inwards and Mr Yanagida continued to ride forward using his whip. As a result, RISING ROAD was checked and hampered. He said that Mr Yanagida did make some effort to straighten his mount but it was too late, adding that Mr Yanagida should have taken the corrective action much earlier.

In response Mr Yanagida said that although his mount shifted in, Ms Fawcett’s mount also shifted outward and therefore contributed.

Mr Harris said that Mr Yanagida continued to ride forward with the whip and hit his mount “once too many” and as a result the damage was done (with reference to the interference to RISING ROAD). He added that Mr Yanagida is trying too hard at the moment and this is affecting his judgement.

Submissions for Penalty:

Mr Williamson produced Yanagida’s riding record which indicated 3 previous breaches under the Careless Riding Rule in the last 12 months. The most recent having incurred at the Auckland RC meeting on 29 February 2020 and resulted in a 7-day suspension. Mr Williamson considered Mr Yanagida’s record to be a neutral factor.

Mr Williamson said Stewards assessed the level of carelessness as low range, but the consequences of Mr Yanagida’s actions was that the check cost RISING ROAD the opportunity to finish in 3rd place (noting the nose margin between 3rd and 4th). Therefore, he assessed the carelessness to be in the low to mid-range and added he agreed with Mr Harris that Mr Yanagida is trying too hard. He said that in assessing penalty Mr Yanagida ought to be given credit for his admission of the breach. He submitted a suspension consistent with a low to mid-range breach would be appropriate under the circumstances.

In response Mr Yanagida advised he has confirmed engagements up to the Rotorua meeting on 2 December 2020 and sought a deferment to any proposed suspension until after racing on that date.

Mr Harris advised that Mr Yanagida is under pressure to perform at the moment, thus the reason for him trying too hard to impress.

Reasons for Penalty:

After considering the submissions and reviewing the race film and the Committee determined Mr Yanagida’s carelessness to be in the low range and we adopted a 6-day starting point, with a 1-day uplift applied. This was due to the check to RISING ROAD most likely costing that runner the opportunity to finish in 3rd place (given the margin between 3rd and 4th was a nose). This is in conformity with the Penalty Guide for Judicial Committees.

The available films established that Mr Yanagida allowed his mount to shift in, bumping into and making solid contact with RISING ROAD. Mr Yanagida was slow to take corrective action and allowed his mount to hamper RISING ROAD for a few strides. The mitigating factors we considered included Mr Yanagida’s admission of the breach and his riding record under this rule. Although this is Mr Yanagida’s fourth breach, his last breach occurred more than 9 months ago. For those combined factors we afforded him a 1-day reduction from the 7-day starting point.

After taking into account all the above factors the Committee considered that an appropriate suspension was 6 (national) days.
