Mr Rusof's Jockey's Licence was suspended from the close of racing on 23 September up to and including racing on 5 October 2018 (7 days). Mr Rusof was told by the Chairman that his record was of concern and that he needed to take heed and demonstrate greater care in his future race riding.
Facts:
Following the running of Race 2 (Vilagrad Winery 1400), Information No.A10077 was filed with the Judicial Committee. It was alleged by the Informant that Mr Rusof permitted his mount "SPEEDKEEPER" to shift outwards near the 300m making solid contact with "RAZOR" which was badly unbalanced.
Rule 638(1)(d) provides:
A rider shall not ride a horse in a manner which the Judicial Committee considers to be: careless
Mr Rusof said that he understood the Rule, Charge and confirmed that he admitted the breach of the Rule.
Mr Jones identified all runners involved on the film replays. His submission was that near the 300m Mr Rusof and his mount were racing in the trail behind the leader "LE PATRON" which had began to weaken. He said that Mr Rusof shifted his mount out away from the rail and in doing so his mount made very firm contact with the hindquarter of LE PATRON and as a consequence LE PATRON became very unbalanced. Mr Jones added that there was not a clear run for Mr Rusof; that he was a 1/2 length behind LE PATRON when he shifted outwards.
Mr Rusof said that it was his fault what had happened. He said that the leader came back on him. He said that he did not wish to make such firm contact but his mount was green and over-reacted.
Submissions for Penalty:
Mr Oatham said that Mr Rusof did not have a good record having been suspended on the following dates:
14 March 2018 - 7 days mid-range
8 April 2018 - 5 days low-range
9 May 2018 - 7 days mid-range
30 June 2018 - 10 days above mid-range
Mr Oatham said that Mr Rusof had resumed riding in New Zealand on 10 March 2018 and his record was in fact relatively poor. He said that he had been caught behind a tiring runner on a green horse; that it was a clumsy move by Mr Rusof with LE PATRON being almost knocked off its feet. He placed the carelessness as no less than mid-range.
Mr Rusof said that his horse was a first-starter, was green and that it shifted outwards further than he expected. He asked that any suspension imposed start after racing on 23 September.
Reasons for Penalty:
The Committee found that near the 300m SPEEDKEEPER shifted away from the running rail somewhat abruptly and that its outside shoulder made very firm contact with the inside hindquarter of LE PATRON. As a consequence LE PATRON's rear end was forced outwards resulting in that horse becoming unbalanced.
The Committee took into account the following matters when determining quantum of penalty:
1. That the carelessness sat within the mid-range category
2. Mr Rusof's relatively poor record
3. The admittance of the breach
4. The JCA starting point for mid-range carelessness (8 days)
5. SPEEDKEEPER being a first-starter hence a little green which over-reacted when being shifted.
