Facts:
Mr. M. Cameron, rider of ‘Jacks Run’ provisionally placed 2nd by the judge, lodged a protest against ‘Kokoda’ (Mr. H. Tinsley) placed 1st by the judge alleging interference in the final straight.
Provisional placings were:
1st Horse 2 Kokoda
2nd Horse 1 Jacks Run
3rd Horse 4 Kormazyn
4th Horse 8 Persian Dancer
The margin between 1st and 2nd was ½ length. Stipendiary Steward Mr. Goodwin read the rule, and all parties indicated they understood the rule.
Submissions for Decision:
Mr. M. Cameron using the available films (head, side on and rear) submitted that in the run down the straight he was travelling in the trail and then received a decent knock when Mr. Tinsley’s mount moved outwards. He believed he was knocked at least 2 – 3 other times as Mr. Tinsley angled his mount outwards and into his rightful line. He informed the committee that his horse was turned when contact was made and felt the knocks made it difficult for his mount to be balanced over the final stages.
Mr. Tinsley had no questions.
Mr. K. Gray, trainer of Kokoda, submitted that at no stage was Jacks Run knocked off balance and the horse's actions were consistent and even.
Mr. R. James, trainer of Jacks Run, submitted that under the rules he was entitled to hold his ground and he believed that Mr. Cameron was forced about 3 wide after being one off the fence.
Mr. Tinsley informed the committee that under the rule 642 (1) the committee had to be satisfied that the horse interfered with, in this case Jacks Run, would have finished ahead of his mount Kokoda had such interference not occurred. He concurred with Mr. Cameron that interference did occur but did question the number of times contact was made.
Mr. Tinsley submitted that Jacks Run did not lose anywhere near the momentum submitted by Mr. Cameron and he wasn’t making up the necessary leeway in the final run to the line bearing in mind the margin between 1st and 2nd was ½ a length. And that the incident occurred at about the 200 metre mark.
Mr. Goodwin (Stipendiary Steward) agreed with both parties that interference did take place. He believed that Mr. Cameron’s mount was unbalanced due to contact being made 3 – 4 times. However, he was unsure that once becoming balanced in the final run to the line whether his mount was making the necessary in roads into the lead established by the eventual winner. He pointed out again the official margin of ½ a length between 1st and 2nd.
Mr. Brown representing the owner of Jacks Run was asked to comment but indicated that he was happy to leave any comments to his trainer Mr. R. James.
Reasons for Decision:
The committee carefully considered all of the submissions placed before it. There is no question that interference did occur. Mr. Tinsley, as the available films showed, did angle his mount outwards and onto the line taken by Mr. Cameron to which he was entitled. Contact was made on at least 3 occasions prior to the 200 metre mark.
The committee revisited rule 642 (1) and then had to be satisfied that the horse interfered with (Jacks Run) would have finished ahead of Kokoda had such interference not occurred and believed that some doubt existed.
Mr. Cameron’s mount did become unbalanced for a number of strides and then picked itself up in the final run to the line however, the committee was adamant that over the final stages no appreciable ground was being taken off the eventual winner.
