Accordingly, pursuant to Rule 632 the Committee exercised their discretion and declared TOPARTS to be a non–starter.

Facts:

Following the running of Race 2, Fell Engineering 1000, Licensed Trainer, Mr S McKee, lodged an Information requesting a ruling in relation to Rule 632 to establish if TOPARTS was denied a fair start.

Rule 632 provides “If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placing’s was prevented from taking an effective part in a race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away of its own accord), the Judicial Committee may declare such horse to be a non-starter.”

Submissions for Decision:

Mr Coles identified on the head on video film that a barrier attendant was holding onto TOPARTS when the gates opened. He said this resulted in TOPARTS rearing and losing considerable ground.

In response to a question from the Committee, Mr Coles said the Stewards were of the view that TOPARTS was denied a fair start and should be declared a non–starter.

Mr McKee said it was clear on the video film that TOPARTS was held for too long. He said in doing so TOPARTS attempted to jump in the air and follow the other horses away from the starting stalls.

Miss Spratt submitted that when the stalls opened the barrier attendant was holding onto TOPARTS. As a result of this the horse reared high in the air and she was lucky to stay in the saddle.

In response to a question from the Committee, Miss Spratt said TOPARTS ended up losing a fair bit of ground at the start.

Mr Harrison submitted the films were self–explanatory in that the barrier attendant was trying to straighten TOPARTS head when the gates opened. He noted this resulted in TOPARTS rearing and losing ground. He added the horse was denied a fair start.

Reasons for Decision:

The Committee carefully considered the submissions presented and reviewed the video footage. It was clear on the video footage that TOPARTS starting stall did open in line with the rest of the field. However, as TOPARTS tried to jump out of the stalls it was denied a fair start because the barrier attendant was still holding onto TOPARTS right rein. This resulted in TOPARTS rearing and placing Miss Spratt in an awkward position. We are satisfied that this materially prejudiced the chances of TOPARTS as she jumped away awkwardly and settled at the rear of the field after losing at least 4 lengths at the start. We accept no fault could be attributed to TOPARTS being slow of its own accord The submissions of all parties were compelling in that TOPARTS lost ground at the start and was denied a fair start.
