After taking all the above into account we impose a fine of $200.

Facts:

Following race 1, an information was filed pursuant to rule 636 (1) (c).  Mr Williamson alleged that Mr D Nolan, rider of TWILIGHT DRAGON, failed to ride his mount out to the end of the race.   

Submissions for Decision:

Mr Oatham demonstrated the video films and pointed out to the committee TWILIGHT DRAGON racing in fifth position in the run up the straight to the finish.  At this stage Mr Nolan was riding vigorously with the whip but with approximately 75 metres to run he relaxed and changed his riding style.  He obviously thought he was not going to better his fifth placing but, in the final stages NO REDEMPTION finished very fast and beat him by a neck for that fifth position.

Mr Nolan said his mount got very tired and that was the only reason he sat up.

Submissions for Penalty:

Mr Williamson told the committee that TWILIGHT DRAGON had been examined following the race and cleared by the Vet.  He said this was Mr Nolan's first charge under this rule and submitted a fine of $200 -$300 would be appropriate.

Mr Nolan submitted the penalty recommendation was a bit heavy.

Reasons for Penalty:

The committee considered all evidence and submissions.  In Mr Nolan's favour are his admission of the breach and that this was his first charge under this rule.  It could be said, that Mr Nolan was unlucky as NO REDEMPTION finished very fast and very wide out on the track.  However, as explained to Mr Nolan, it is imperative that all Jockeys ride their mounts right out to the line even if they are tired.  In this case the owners were denied a stake of $175 through Mr Nolan sitting up.
