We exercise our discretion and relegate ROXY ROCKET to behind FLYIN ARMALIGHT.

Amended placings are:

1st    9  ARMA COURAGE
2nd 10  IDEAL TACT
3rd   4  ARDLUSSA ELIZA
4th   8  HIGHVIEW MACUSHLA
5th   2  INFREQUENTLY

Dividends and stakes are to be paid accordingly.

Facts:

Mr Allison alleged that with approximately 300 metres to run in race 12 the Southern Golden Girls Heat, ROXY ROCKET (S Walkinshaw) shifted ground inwards checking FLYIN ARMALIGHT (J Cox), which broke losing its chance.

Judge’s placings were:

Margins were: 3L; 1/2 head; neck.

Rule 869(8) states:

The Judicial Committee may in addition to any other penalty which may be imposed pursuant to r 1003 thereof place any horse which:
(a) may have gained an advantage by any conduct or interference prohibited by any preceding provision of this Rule and/or
(b) may have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses, immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby.

Submissions for Decision:

Mr Allison demonstrated on 3 video angles that as the horses were straightening for the run home ROXY ROCKET shifted ground inwards and in so doing crowded FLYIN ARMALIGHT, which broke losing all chance. Mr Cox was sitting parked at the time and Mr Walkinshaw was improving 3 wide immediately outside FLYIN ARMALIGHT. Mr Allison stated that as Mr Walkinshaw was activating gear on the point of the turn ROXY ROCKET ducked sideways and came into contact with FLYIN ARMALIGHT. He said Mr Cox had to take hold as a consequence.

Mr Cox said ROXY ROCKET was improving on his outside when the horse ducked in when Mr Walkinshaw was activating the removable gear. He said the off hind leg of FLYIN ARMALIGHT came into contact with the cart of ROXY ROCKET and FLYIN ARMALIGHT broke as a consequence. He described Mr Walkinshaw’s movement as sudden. He said there was no movement from his inside and FLYIN ARMALIGHT was running straight.

Mr Anderson said FLYIN ARMALIGHT had performed well in its 4 previous starts and was racing kindly when the interference occurred, which caused the horse to gallop.

Mr Walkinshaw said that as he was activating the removable blinds ROXY ROCKET ducked in and he brushed the hind leg of Mr Cox’s horse. He accepted that he had interfered with FLYIN ARMALIGHT and that it was likely that that horse was going to run in the first 4.

Reasons for Decision:

We are satisfied that FLYIN ARMALIGHT suffered interference as a consequence of inwards movement from ROXY ROCKET at the point of the turn. The cart of ROXY ROCKET brushed the off hind leg of FLYIN ARMALIGHT and that horse galloped losing all chance. FLYIN ARMALIGHT was racing in the parked position and was running on when the interference occurred. Both the chances and progress of FLYIN ARMALIGHT were thus affected.
