As Ms Spratt admitted the breach we found the charge proved.

Penalty:

Taking into account Ms Spratt’s upcoming riding commitments we suspend her license from the close of racing on Saturday October 13th up to and including racing on Friday October 26th.

Facts:

Following the running of Race 9 (Red Badge Spring Sprint, Group 3), an Information was lodged by Mr J Oatham alleging that jockey S Spratt allowed her mount to shift inwards near the 200m when not sufficiently clear crowding AMARULA onto DEALS IN HEELS with both runners being checked.

Mr Oatham had Mr Goodwin explain the incident with the assistance of four available video angles.

Mr Goodwin said shortly after making the home turn the field was a little crowded but there was sufficient room for Ms Myers (DEALS IN HEELS) to improve into against the rail. The head-on view confirmed there was a run for her. Mr McKay (AMARULA) was next to her on his rightful line of running. Ms Spratt then allowed her mount to shift in crowding AMARULA onto DEALS IN HEELS causing a bad check to Ms Myers on the rail. Ms Spratt continued to ride with vigour going from a 3-wide position to being in a position on the rail. Mr Goodwin said there had been some initial movement from the mount of Ms Sam Collett, but the Stewards did not believe it had any bearing on the interference suffered by the two runners. Mr Goodwin said Ms Spratt had the opportunity to straighten her mount but did not do so on this occasion.

Ms Spratt said it was obvious that she had checked the two runners to her inside, but she had been outside UGO FOSCOLO the whole race and when that runner dropped away she was unaware two horses had come up on the inside. She admitted they had every right to be there.

Mr Oatham presented Ms Spratt’s riding record for breaches of the careless riding rule over the last 12 months:

01/11/17 - Avondale 5 days
21/11/17 - Waipa 5 days
25/11/17 - Counties 10 days
19/12/17 - Whangarei 5 days

He said Ms Spratt had had a cluster of suspensions towards the end of last year, but it had been 10 months since her last careless riding charge. He described her record as neutral and said Ms Spratt had admitted the breach at the first opportunity. In relation to the degree of carelessness Mr Oatham submitted that looking at the incident overall it sat in the mid to high range.

When invited to make submissions on penalty Ms Spratt said while she had been careless she didn’t really think it was a high range. She advised of riding commitments through until Saturday October 13th and sought a deferment of any suspension until after that date.

Reasons for Penalty:

In coming to a decision on penalty the Committee considered all submissions. Throughout the incident Ms Spratt continued to ride forward and made no discernible attempt to straighten her mount which resulted in interference to two runners on her inside. Ms Myers mount, DEALS IN HEELS, suffered severe interference on the rail. We note that the incident occurred at a vital stage of a Group 3 race, the black type status being an aggravating factor when assessing penalty. Mitigating factors were Ms Spratt’s ready admission of the breach and her record was considered a neutral factor.

The Committee determined that an appropriate penalty was one of 10 riding days.
