As the breach of careless riding was admitted by Mr Hutton it was found to be proved by the Judicial Committee.
Penalty:
Mr Hutton’s Apprentice Jockeys Licence was suspended from the close of racing on 27 December 2016 up to the cessation of racing on 3 January 2017 (6 days).

Facts:
Following the running of Race 6 (Cambridge Stud 8 Carat Classic), Information No. A8652 was filed with the Judicial Committee. Mr Oatham alleged that near the 1400m Mr Hutton, the rider of DEVISE allowed his mount to shift inwards when not sufficiently clear, forcing VOLPE VELOCE inwards crowding AVEC MOI which was checked.
Rule 638(1)(d) provides:
A rider shall not ride a horse in a manner which the Judicial Committee considers to be (d) careless.
Mr Hutton said that he understood the Rule and confirmed that he admitted the breach.
Mr Coles showed all available film replays and said that near the 1400m Mr Hutton shifted his mount inwards to be one off the rail and in doing so made contact with VOLPE VELOCE, who in turn shifted in across AVEC MOI who was sharply checked. He said that Mr Hutton did straighten his mount although that was after the interference had taken place.
Mr Hutton said that AVEC MOI had been slow away and that he was not aware that it had improved up to the inside of VOLPE VELOCE. He said that VOLPE VELOCE had over-reacted and that Mr Parkes, the rider, had not called.
Mr Ritchie, on behalf of Mr Hutton, said that there were mitigating factors in that the pace up front eased and that Mr Hutton did not want to be left sitting 3-wide. He also said that AVEC MOI had not got up inside VOLPE VELOCE when Mr Hutton made the decision to move in.
Submissions for Penalty:
Mr Oatham said that Mr Hutton had breached the Careless Riding Rule on two occasions during the past 12 months, with the most recent being in April 2016. He said that the aggravating factor was that it was a Group 2 event with a stake of $100,000. He added that credit should be given for the admission of the breach and that the Stewards placed the carelessness in the mid-range.
Mr Hutton said that he had a relatively clean record, that he had admitted the breach and that as it was a Group 2 race, you tend to ride more competitively. He said that his only upcoming commitments were at Rotorua the next day (27.12.16) and that he regularly rides at the northern and central district meetings.
Mr Ritchie invited the committee to take into account the slowing of the pace and that Mr Hutton would lose a lot of rides over the next 4 to 5 racing days.
Reasons for Penalty:
The committee found that near the 1400m Mr Hutton let his mount DEVISE shift in when not clear of VOLPE VELOCE who in turn shifted in onto AVEC MOI who had improved up on the inside. As AVEC MOI ran out of adequate racing room, it was relatively severely checked, losing at least 2 lengths.
The aggravating factors were that it was a Group 2 race with prize money of $100,000 and that the carelessness exhibited by Mr Hutton was deemed to be at the higher end of mid-range.
Mitigating matters to be considered were the admission of the breach and the fact that AVEC MOI was racing back and to the inside of VOLPE VELOCE when Mr Hutton elected to shift his mount inwards. Having said that, it is imperative that riders ensure that they are the required distance clear prior to making a shift, as safety to rider and horse is paramount.
Taking into account the JCA starting point of 5 riding days suspension for careless riding, the committee believed that due to the aggravating factors; upper mid-range carelessness and the consequences of such carelessness (relatively severe check to AVEC MOI) and it being a Group 2 event, the committee deemed that an uplift of 2 riding days was warranted. On account of the mitigating matters a discount of 1 day was given.
