Penalty:
After taking all the above facts into account we impose a suspension under provisions of Rule 1106(2)(B). Accordingly we suspend Mr Bosson from riding in races which is to start after racing on 9 April 2011 and conclude after racing on 20 April 2011 (5 days).

Facts:
Following Race 2 an Information was filed pursuant to Rule 638(1)(d). The informant Mr M Williamson alleged that Mr O Bosson, rider of FRENCH CONNECTION, allowed his mount to shift outwards over the final stages when not sufficiently clear causing a check to GOLD ROCK (J Collett) with ST MORTIZ (V Colgan) also being hampered.
Submissions for Decision:
Mr Williamson stated the evidence pertinent to this charge had been well covered in the protest hearing. He demonstrated showed FRENCH CONNECTION racing in a 3 wide position and leading the filed approaching the 100 metres mark. He demonstrated the video films which showed FRENCH CONNECTION racing in a 3 wide position and leading the filed approaching the 100 metres. Mr Williamson submitted that Mr Bosson continued to ride forward with the whip when moving out and insufficiently clear of GOLD ROCK. He said GOLD ROCK received a severe check and a further consequence was the relegation from 1st to 2nd.
Submissions for Penalty:
Mr Williams submitted that Mr Bosson had only incurred 2 suspensions in the last 12 months which was a good record. However with the severity of the check to GOLD ROCK and the relegation which resulted, Mr Williamson submitted a suspension of no less than 5 days would be appropriate.
Mr Bosson submitted that he only had commitments until the Te Aroha meeting on 9 April 2011.
Reasons for Penalty:
The committee carefully considered all evidence and submissions as presented. Mitigating factors are Mr Bosson’s good record and his admission of the breach. However these must be balanced against the severity of the check to GOLD ROCK. Mr Bosson clearly continued to ride forward when his mount was moving out without being the required distance clear. Another aggravating factor is that a relegation occurred through Mr Bosson’s carelessness.
