As Mr Kamaruddin admitted the breach the Committee found the charge proved.

Penalty:

Accordingly, Mr Kamaruddin had his license to ride in races suspended for a period to commence after racing on 4 October and conclude after racing on 13 October 2019.

The race meetings on October 5 and 6 were not included in the penalty because the declaration of riders had closed.

Facts:

Following the running of race 8, Lodge Christmas Raceday – Dec 21 1200, an Information was filed pursuant to Rule 638(1)(d). The Informant, Mr Williamson, alleged that Mr Kamaruddin allowed his mount WEAPONRY to shift out when not sufficiently clear of IMBLAZE which was checked near the 350 metres.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Kamaruddin said that he understood the Rule and confirmed he admitted the breach.
Mr Harris assisted Mr Kamaruddin at the hearing.

Mr Jones demonstrated the incident using the available video footage. He identified that Mr Kamaruddin allowed his mount to shift out near the 350 metres when only 1¼ lengths clear of IMBLAZE. He added that Mr Kamaruddin shifted from a 4 wide position to 7 wide when IMBLAZE was checked.

Mr Kamaruddin said that his mount was hanging out and he looked behind him when he shifted ground.

Mr Harris said that Mr Kamaruddin is an inexperienced Apprentice rider that is still learning his trade. He added that WEAPONRY may have been too strong for Mr Kamaruddin.

Submissions for Penalty:

Mr Williamson said that Mr Kamaruddin was having his 26th race day ride and he had 1 previous breach of this Rule. He said that WEAPONRY was a tough ride for Mr Kamaruddin however he has an obligation not to cause interference. He described the level of carelessness as low range.

Mr Kamaruddin said that he had no engagements in the next 7 days and any proposed suspension could start immediately.

Mr Harris reiterated that Mr Kamaruddin was still learning his trade and was trying hard to get his first win.

Reasons for Penalty:

The Committee considered all the evidence and submissions presented.

When reviewing the video footage the Committee found that Mr Kamaruddin allowed his mount to shift out near the 350 metres when insufficiently clear of IMBLAZE. As a consequence that runner had to be steadied off heels when checked. The Committee deemed the level of carelessness displayed by Mr Kamaruddin was low range.

The JCA Penalty Guide starting point for low range carelessness is 6 national riding days which we adopted.

The mitigating factors were Mr Kamaruddin’s admission of the breach and his inexperience as an Apprentice rider. For these collective factors he was afforded a 1 day reduction in penalty.

After taking into account all the above factors the Committee considered that an appropriate suspension was 5 national riding days.
