As Mr Jones admitted the breach we find the charge proved.

Penalty:

We grant Mr Jones' request to seek a deferment to his suspension as per Rule 1106(2).

Accordingly, we impose a suspension on Mr Jones which will commence after racing on 18 December and conclude after racing on 26 December 2013 (4 North Island days).

The penalty did not include any South Island meetings as Mr Jones confirmed that he did not intend riding there.

Facts:

Following the running of Race 2, PAYMARK 1200, an Information was filed pursuant to Rule 638(1) (d). The Informant, Mr Williamson, alleged that Mr Jones allowed his mount SPARE THE MOMENT to shift in when not clear of BROKASH (K Leung) which had to be checked losing ground. Also crowded near the 1100 metres were DESIGNATED DRIVER, ALICE WEB ELLIS and PETRIFY.

Mr Jones acknowledged that he understood the nature of the charge, the Rule and confirmed his admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Coles identified on the head on film Mr Jones had drawn barrier 9 of 9. He showed where shortly after the start Mr Jones angled his mount in when only ¾ to 1 length clear of BROKASH. This resulted in BROKASH losing one and a half lengths which inconvenienced 3 horses racing on his inside. He added Mr Jones did straighten his mount up but it was 2 strides too late.

Mr Jones said he thought he was the required distance clear but conceded he “shaved” Mr Leung’s mount BROKASH. However, he pointed out on the head on film where Mr Bosson’s mount PETRIFY which had drawn barrier 3 moved out approximately 2 horse widths. He believed this contributed to the interference and viewed this as a mitigating factor.

Submissions for Penalty:

Mr Williamson produced Mr Jones’ record which showed 3 previous breaches under this Rule in the last 12 months. He described Mr Jones' record as fair and noted it was 5 months since he breached this Rule. He assessed the level of carelessness as low end and accepted the mitigating circumstances raised by Mr Jones. Mr Williamson submitted a suspension in line with the carelessness would be appropriate.

Mr Jones advised that he had upcoming commitments at Matamata on December 18, and requested a 7 day deferment to his proposed suspension.

Mr Jones confirmed that he rode only in the North Island and added it had been a long time since he had ridden in the South Island.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. We have adopted 5 riding days as the starting point in considering the term of suspension. The mitigating factors are Mr Jones’ admission of the breach and the level of carelessness is at the low end. We accept there was a contributing fact to the interference and we note Mr Jones did attempt to relieve the pressure albeit too late. We assess his record under this Rule as average.

After taking into account all the above factors we consider an appropriate penalty is a 4 day suspension.
