The Protest is not contested and it is therefore upheld. BOBBY BREEN is therefore disqualified from the race.

The amended placings are now :

First - (3) SUNSET PEAK

Second - (8) COOL COBBER

Third - (4) MAJESTIC ALI

Fourth - (6) CHARLEMAGNE

Fifth - (2) PRINCESS MACKENDON

It is ordered that stakes are paid in accordance with the amended placings.

Facts:

Following the running of the SIMS PACIFIC METALS HANDICAP TROT an Information instigating a Protest was lodged by Stipendiary Steward Mr S Mulcay against the 5th placing of BOBBY BREEN on the grounds that it broke from its gait in the last 200 metres and galloped in excess of 50 metres.

Rule 870(3) requires: any horse which breaks from its gait during a race to promptly regain its proper gait.

The Breaking Horses Regulations provide: that any horse which breaks from its gait and gallops in excess of 50 metres in the last 200 metres of a race shall be in breach of Rule 870(3).

Mr M Bowden the Trainer of BOBBY BREEN endorsed the Information with the words " I do not contest the Protest".  Mr Bowden also advised that he did not wish to be present at the Hearing.

Stipendiary Steward Mr JM Muirhead demonstrated the incident by use of the race films and showed where BOBBY BREEN broke from its gait in the home straight and galloped in excess of 50 metres.

Submissions for Decision:

Stipendiary Steward Mr Mulcay submitted that BOBBY BREEN was in breach of Rule 870(3) and therefore should be disqualified from the race.
