Decision:

Mr Bradley having admitted the breach, the charge was found proved. 

Penalty:

The Committee was satisfied that Mr Bradley had riding engagements for the 2nd and 3rd days of the meeting (13 and 16 November) and allowed a deferment of the suspension for 7 days pursuant to Rule 1106 (2) (b). Mr Bradley’s jockey’s licence is suspended from the conclusion of racing on Saturday, 16 November 2013, up to and including Saturday, 23 November 2013 – effectively, 4 riding days. The meetings intended to be encompassed by the term of suspension are Woodville on 18 November, Matamata on 21 November, New Plymouth on 22 November and either Counties or Palmerston on 23 November. 

Facts:

Following the running of Race 8, Winning Edge Presentations Premier, an information was filed by Co-Chief Stipendiary Steward, Mr R L Neal, against Licensed Jockey (Class A), Mr D G Bradley, alleging that Mr Bradley, as the rider of WORD’S OUT in the race, “near the 1400 metres he permitted his mount to shift in dictating PARTY ICE inwards into the line of FINTORRO which was checked”.

Mr Bradley was present at the hearing of the information and he indicated that he admitted the breach. Rule 638 provides as follows:

(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:

    (d) careless. 

Mr Neal had Mr M Zarb, Stipendiary Steward, show the incident on head-on and side-on video replays. Mr Zarb pointed out that, shortly after the start of the 1400 metres race, Mr Bradley riding WORD’S OUT, which had drawn barrier 15 in the 18-horse field, shifted inwards onto PARTY ICE (M R du Plessis) and dictated that runner inwards onto FINTORRO (J C Bates). He showed the latter runner being “crowded badly”, its head go up and lose ground.

Mr Bradley referred to the head-on video replay. He said that he had come across quickly and got outside of PARTY ICE. He submitted that he had straightened his mount but had gone “that stage too far” and was not clear of that horse when he went in – he needed to go forward a little more, he said. He admitted that he had put pressure on PARTY ICE and hence his admission of the breach. He further submitted that the field had been “racing tightly”. Mr Bates had been “squeezed” for 3-4 strides and, while Mr Bates’ mount had not lost ground, it had been put in a “tight position”, resulting in Mr Bates having to restrain. He admitted that he had ridden carelessly.

Submissions for Penalty:

Mr Neal described Mr Bradley’s record as “a very good one” having regard to the number of rides that he has. He had incurred one suspension in the past 12 months – on 8 March 2013 at Otaki where he received a 3-days’ suspension.

Mr Neal said that the Stewards agreed that the field was racing quite tightly when Mr Bradley shifted. That shift was not a significant one, Mr Neal submitted, but the consequences to Mr Bates’ mount were that it was placed in restricted room and Mr Bates had to steady.

The Stewards assessed the degree of carelessness as being at the lower end – the shift was not great and the consequences to Mr Bates were not “overly significant” in that he lost ¾ to 1 length in the incident, Mr Neal said.

Mr Neal submitted that the appropriate penalty was a period of suspension and he left it to the Committee to determine the length of that suspension.

Mr Bradley told the Committee that there was a lot of racing in the next week and he sought a deferment until after next Saturday, 16 November. He confirmed, in response to a question from the Committee, that he had riding engagements on the 2nd and 3rd days of the meeting.

He said that he was doing a lot of riding for trainer, Lisa Latta, who had two stables. He would not be riding at Winton on 20 November, he said. Mr Neal conceded that Mr Bradley has been riding in the Auckland-Waikato area of late. Mr Neal said the he considered Mr Bradley to be a “North Island rider”.

Mr Bradley said that he was having a successful season and was being approached a lot to ride.

Reasons for Penalty:

In determining penalty, the Committee took a starting point of 5 days, as recommended in the Penalty Guide. The Committee could find no aggravating factors, so there was no need to increase that starting point.

Mitigating factors were, firstly, Mr Bradley’s very frank admission of the breach (although somewhat inevitable) and, secondly, his record which the Committee accepted was good.

The Committee also took into account, to a lesser extent, that the carelessness was at the lower end of the scale and that the field was racing tightly at the time of the incident. The Committee allowed a discount of 1 day for these matters, Mr Bradley’s admission of the breach and his good record.
