Following the running of race 9 information number A2388 was filed with the judicial committee by Stipendiary Steward Mr J Muirhead under rule 869 (2) (a). The information stated that Mr McKendry used his whip excessively when driving out River Emperor in the home straight.
The committee was advised that Mr McKendry did not wish to be present at the hearing.
Facts:
Mr Muirhead used the films to identify Mr McKendry and to show what had occurred. He said that Mr McKendry had used his whip 25 times without giving his horse any reasonable break.
Submissions for Penalty:
Mr Muirhead said that Mr McKendry had a good record and that recent penalties imposed for similar breaches had been met with fines of between $200 and $300. He also asked the committee to take into account that it was a lower grade race.
Reasons for Penalty:
The committee took into account all matters that were raised during the hearing and to be consistent with other penalties imposed at the meeting determined that a fine of $200 was an appropriate.
