As the charge was admitted together with the film evidence, the Committee deemed the breach proved.

Penalty:

Ms Hemi’s Jockey Licence is suspended from the end of racing on 12 February through to 21 February 2021 inclusive (5 Riding Days).

Facts:

Following the running of Race 7, (Fasttrack Insurance Oaks Prelude), Information No. A14126 was filed with the Judicial Committee. It was alleged by the Informant that Ms Hemi had allowed her mount to shift out near the 250m when not clear of SUMI which was checked.

Ms Hemi said that she understood the Rule and the Charge and confirmed to the Committee that she admitted the breach.

Mr Williamson showed film replays and identified the horses involved. He said that LLANACORD shifted out when only a bare length clear of SUMI which was checked.
He added that LILY’S LADY who was racing outside SUMI did shift in a little which was a mitigating factor.

Ms Hemi said that she admitted that she did shift out into SUMI’s line and that LILY’S LADY did shift in a little and although it did not contribute it made the incident look worse.

Submissions for Penalty:

Mr Goodwin said that Ms Hemi had a clear record over the past 12 months.

Ms Hemi said that she would like any suspension imposed to commence following racing on 12 February 2021.

Reasons for Penalty:

The Committee placed the carelessness in the mid-range category with the JCA Penalty Guide Starting Point being a 5-day suspension plus a fine of $500.

A 1-Day uplift was imposed due to the fact that the incident occurred in a Listed Race.
Taking into account Ms Hemi’s excellent riding record a discount of 1 Day was afforded with a fine being waived.
