After viewing the films and hearing the evidence from the Stewards the charge was found proved.

Penalty:

Mr House is fined the sum of $300.

Facts:

Following the running of race 3, the Port FM Mobile Pace, an information was lodged by Stipendiary Steward Mr S Renault against Mr M House, alleging a breach of Rule 869 (2) (a), in that Mr House “…used his whip excessively over the concluding stages when driving Lloydin Magic.”

Rule 869 (2) (a) reads as follows:

No horseman shall during any race: use his whip in an unnecessary, excessive or improper manner.

Mr House indicated on the Information that he admitted the charge, and did not attend the hearing.

With the use of the videos Mr Renault showed that Lloydin Magic was improving wide on the turn to challenge the leaders. He said Mr House used his whip approximately 22 times over the final 200m, which the Stewards believed was excessive. He said Mr House had not broken up the use of the whip which was continuous.

Submissions for Penalty:

Mr Renault stated Mr House had admitted the charge when spoken to by the Stewards. He had had a limited number of drives over the past two seasons and had a clear record. Mr House indicated to the Stewards he preferred a fine. The JCA Penalty guide recommended a starting point of $500 and taking into account Mr House’s excellent record was seeking a fine of $300.

In determining penalty, the Committee took into consideration Mr House’s admission of the breach, his cooperation with the Stewards and his excellent record.
