Facts:
Prior to the running of Race 1 (Rock N Pop @Waikato Stud 3 YO Maiden), Information A6773 was lodged with the judicial committee. It alleged a breach of Rule 330(3)(c) in that Mr Lammas "failed to make the required weight for TOULOUSE (1 kilo overweight)."
Rule 330(3)(c) states: "A Rider shall not...(c) fail to ride a horse at the weight at which it is handicapped to carry."
Mr Lammas confirmed he understood the rule and that he admitted the breach.
Mr Goodwin advised that Mr Lammas had attempted to lose the remaining weight this morning with a couple of runs up the straight, but despite his efforts he remained 0.1 kgs overweight.
Mr Lammas submitted that he had returned home later than usual as a result of riding at the Taranaki twilight meeting the night before this meeting, and that his young child had not slept well; so he did not have his usual routine to lose the weight required, hence he had weighed in just slightly overweight.
Submissions for Penalty:
In presenting Mr Lammas' record, Mr Goodwin submitted that it could be viewed as "not a good record" in relation to previous breaches of this rule. His most recent was on 20 September 2014 for which he received a $200 fine. Prior to that he received the same monetary fine for a breach on 16 June 2014. Mr Goodwin believed there were extenuating circumstances on this occasion, that Mr Lammas had referred to and believed a fine of no more than $200 was appropriate.
Mr Lammas concurred with Mr Goodwin's submissions and had nothing further to add.
Reasons for Penalty:
The committee considered all of the submissions placed before it. During the previous 2013 year, Mr Lammas' record identified 8 breaches of this rule. The 2014 year currently identifies this as Mr Lammas' fourth breach of this rule. While the circumstances that have been advanced in mitigation by Mr Lammas have been considered, the reality is that Mr Lammas had a responsibility to connections to fulfil his obligations. The result on this occasion has been that a replacement rider had to be found for the connections of TOULOUSE due to Mr Lammas being overweight. While the overweight quantum is minimal at 100 grams; it is still overweight. The committee believed that a fine slightly higher than the penalty for Mr Lammas' previous breach was appropriate.
