Mrs Barclay has admitted the breach which we thus find proved.

Penalty:

Mrs Barclay was fined the sum of $200 and reminded of her professional obligations.

Charge:

Following race 1, The Mataura Licensing Trust Pace Stipendiary Steward (C.J.Allison) alleged that Mrs K. Barclay (STEELY BLUE) used her whip excessively over the final 300 metres.

Facts:

Mr Allison stated that STEELY BLUE had led into the home straight on the final time and that Mrs Barclay had used the whip “ Lightly” a couple of times.
After entering the home straight Mr Allison stated that Mrs Barclay continued to use the whip, to a total of 20/21 times to the winning post. Mr Allison stated that Mrs Barclay should have broken up the strikes rather than continuing to use the whip.
Mrs Barclay stated the horse was very lazy and difficult to drive and she believed after entering the home straight she used the whip on 17 occasions only.
Mrs Barclay also stated that the previous driver and the trainer were also aware of the horse having lazy racing manners.

Submissions for Penalty:

Mr Allison stated that Mrs Barclay had no previous breaches under this rule in the past twelve months.
Mr Allison stated that he believed the breach was at the lower end of the scale.
Mrs Barclay asked the committee to show some leniency due to the earlier admittance of the breach and that a fine rather than a suspension would be her preference.

Reasons for Penalty:

The committee considered all of the submissions and in our opinion we believe the breach to be at the lower end of the scale. The committee also gave credit to Mrs Barclay for her early admission of the breach and also that she had no previous breaches under the rule.
